# 104 DAVID FLETCHER CLOSE TO DEATH


When I first met David Fletcher in jail he told me he was innocent; that he had not raped Yang Dany. I told him that this is what most criminals in jail say; that they are innocent. I told him that I would not necessarily believe anything he said to me and that I would look for evidenced of his guilt. He said, “That’s fine by me.”

He told me also in this first meeting that he had passed up opportunities to buy his way out of jail. $20,000 was the price he had been quoted. “I will either walk out of here an innocent man or be carried out feet first.”

David Fletcher is a proud and stubborn man. He would rather die with his boots on, on his own terms, than either rot in jail or bribe his way out. It had been suggested to him, given his age, that he could write to the King and ask for a pardon. “For what!?” he exclaimed, indignant, “I am not guilty.”

David Fletcher has insisted all along that he is not guilty of having raped Yang Dany. Try as I did, I could find no evidence in court documents or elsewhere that he raped this young woman. A doctor’s report for  the court said Yang Dany was a virgin, her hymen intact, after the alleged rapes. Yang Dany said the rapes had not occurred. So did her mother, Kheang Sekun. This was enough for me to begin to advocate for David Fletcher’s right to a fair trial. I was convinced of his innocence but it had to be a Cambodian court that arrived at this conclusion; a Cambodian court that was not doing the bidding of Samleang Seila and Action Pour les Enfants.

I have written over 100 blog entries in an attempt to secure David Fletcher a fair trial. I have failed, to date, to achieve my goal. For as long as there was some light at the end of the tunnel David Fletcher was prepared to delay his decision to end his life on his own terms.

I was in two minds about Mr Fletcher’s suicide plans. On the one hand I understood how and why, at age 70, a 10 year sentence in a Cambodian jail was essentially a death sentence. On the other hand, an optimistic streak in me thought that there must he some way of mustering support for him in light of the overwhelming evidence of his innocence.  My optimism, I realized, was a luxury I could afford as I was not in jail; was not in hell. How would my ‘optimism’ stand up in the face of five years in jail for a crime that I had not committed? How would my ‘optimism’ stand up in the face of, my own embassy’s, my own government’s refusal to supply me with any support at all?

A week ago, in the middle of the night,  David Fletcher confided in a friend that he had decided to take the Midnight Express; to kill himself. He did not confide this in me because he had, on more than one occasion, told me that he would not kill himself for as long as he believed that my efforts on his behalf might bear fruit – even if that ‘fruit’ was nothing more than a fair trial. David shared with me the belief (naïve of both of us, probably) that in a fair trial in which facts, evidence and truth trumped the blindingly obvious lies of NGOs such as Action Pour les Enfants, he must surely be found to be innocent of the charge of rape. His key witness would testify that she had not been raped and a doctor’s report would support her statement. It was a lay down mazaire! Or so we thought.

When David Fletcher arrived at the conclusion that the odds were so stacked against him that there would be no fair trial, that he had been abandoned by the British government, he decided to end his life. His best laid plans did not reach fruition and, despite his desire to die with dignity and of his own volition, he is now in hospital, in a coma from which he may not emerge. He may achieve his goal but it is not going to be the easy death he had in mind. It may even be that his body, in defiance of his wishes, will refuse to die. I hope so.

I have always, in my advocacy of Mr Fletcher, asked him if this or that blog entry was OK by him to publish. Invariably he would tell me that he trusted me and that I could write what I liked about him; that he had no secrets to hide.

For a few days now I have pondered how best to deal with David Fletcher’s  suicide attempt. Would David want me to make it public? Or keep it private? I suspect that his response would be, “Fuck it, it’s the truth. I have nothing to hide. Publish it.”

I am not sure if this is the right decision. Perhaps there is no right decision. Time will tell:

As I was in the process of writing my 36th letter to you on 23rd March, David Fletcher attempting to end his life.

When I discovered this I wrote immediately to Nigel Eustace at the British Embassy in Phnom Penh.

Dear Nigel

I wonder if you are aware that David Fletcher attempted to take his life yesterday?

The information I have is 2nd and 3rd hand as I am in Australia but it would appear that, after Mr Fletcher's failed suicide attempt, he was taken to hospital and treated for a 'heart attack'.

I have been unable to acquire any further information from the prison and wonder if you, and the British Embassy in Phnom Penh, have any further knowledge of Mr Fletcher's well-being.

If you could keep me posted and pass my best wishes on to Mr Fletcher I would appreciate it.

I did not receive any response to this email so, five or six hours later, wrote another email to Nigel Eustace.

Dear Nigel

As your business day in Cambodia comes to a close I have received no response from you to my email of five hours ago. Perhaps you are not in the office today. Perhaps you are on holidays!

I will copy this to others in the Foreign and Commonwealth Office in the hope that, for a change, someone may respond to me.

It has been confirmed that David Fletcher has survived his suicide attempt and is in hospital and apparently will survive. Beyond this I know little other than that the official reason for his being in hospital is that he had a 'heart attack'. He did not. Mr Fletcher has been talking for a long time about his desire, if he could see no hope at all of receiving a fair trial, of ending his life on his own terms - with his boots on and dressed in his own (and not prison) clothes.

Perhaps the FCO will want to go along with this 'heart attack' fiction also, given that you and all others who have thwarted Mr Fletcher in his quest for a fair trial, will want to absolve yourselves of any responsibility for creating (and maintaining) the sense of hopelessness that pervades his life and led him to wish to end it.

All of you at the FCO know that David Fletcher cannot possibly be guilty of rape and yet you have done nothing at all to assist him in the quest for a fair trial. Indeed you, Nigel, along with your co-workers right up through the ranks to the Foreign Secretary, Mr Phillip Hammond, have done all you can to prevent Mr Fletcher from being given a fair trial - up to and including the destruction of evidence, in the form of his passport.

Mr Fletcher is a proud and stubborn man and now that he has demonstrated that he does not make idle threats I have no doubt but that he will make another attempt on his life when he is in a position to do so. I doubt that he would fail a second time around.

Mr Fletcher's death would be most convenient for the FCO as it would bring this sorry drama to an end for all those, including yourself, who have been complicit in seeing to it that an innocent man remains in jail.

I hope that Mr Fletcher does not give you the satisfaction of dying but that he finds the courage to stay alive and to have his day in court - both in Cambodia and the United Kingdom.

Whilst Mr Fletcher attempted to die by his own hand, he had many assistants - including yourself and your fellow FCO co-workers. One of those who, with malicious forethought, sought to destroy Mr Fletcher was Scott Neeson. I have sent a note to Scott about his involvement in the destruction of Mr Fletcher's life. 

Scott will not respond to the email below - just as none of the others who have played a role (large or small) in the destruction of Mr Fletcher's life (including yourself) respond to questions put to them about their involvement.

Dear Scott

David Fletcher tried to kill himself yesterday. It would seem that he did not succeed.

It was Mr Fletcher’s choice to end his life but his choice, like all life choices, was made in a context.

Context: David Fletcher was sentenced to 10 years in jail, without the benefit of a trial, for a crime that he could not have committed – unless, that is, the Phnom Penh Municipal Court judges were correct in their assertion that Yang Dany’s hymen must have grown back after he had twice ‘brutally raped’ her.

Context: For two years prior to his arrest in Thailand various NGOs (SISHA, CEOP, APLE) put a lot of time and energy into finding evidence that David Fletcher had been ‘grooming young girls’ and worse. No such evidence was found.

Context: A week or so before Mr Fletcher’s arrest, the now thoroughly discredited journalist Andrew Drummond quoted you in an article he write as follows:

“There is little doubt Fletcher devotes his time to grooming young girls….The fact is these children can be bought. It’s difficult to stop it. The British Embassy have been told about Fletcher. Many organizations have files on him, but nothing has happened. If you can get this guy sent packing you are doing a service to the children here.”

I have asked you this question many times now, Scott, but will ask it again:

“Did you have, in 2010, any evidence at all that David Fletcher was ‘grooming young girls’?”

Quite apart from this statement being defamatory if not true it is one that played a significant role in the trial by media that occurred in relation to David Fletcher. Your ‘grooming’ allegation, picked up and amplified by Peter Hogan and Khmer440, turned rumour, innuendo and scuttlebutt into accepted wisdom and David Fletcher became fair game for internet trolls and NGOs such as CEOP, SISHA and APLE seeking a pedophile scalp that would assist them in their money-raising activities.

The role that you personally played in the destruction of David Fletcher’s reputation was and remains a significant one.

Given that Yang Dany and her mother both insist that David Fletcher did not rape Yang Dany and given that there is no evidence that he did , the only crime that David Fletcher could credibly be guilty of is your allegation that he was ‘grooming young girls’.

In the interests of justice I ask you yet again, Scott:

“Do you have any evidence, other than rumour and scuttlebutt, that David Fletcher was ‘grooming young girls’ at the time you told both Andrew Drummond and the British Embassy in Cambodia that he was?”

A simple ‘yes’ or ‘no’ answer is all that is required, Scott.

If you are capable of empathy for a fellow human being, Nigel, for a fellow citizen of the United Kingdom, please at least make a phone call to the hospital and enquire after Mr Fletcher's well-being. Please stop doing everything in your power to thwart Mr Fletcher's right to a fair trial. Please provide Mr Fletcher with the documents promised to him in Jan this year and provide him with at least of a glimmer of hope that he can and will have his day in court.

I did not receive any response to my email of two days ago – from Nigel Eustace or anyone else at the British Embassy in Phnom Penh so, concerned for Mr Fletcher’s well-being, I have flown to Cambodia and visited Mr Fletcher in hospital this morning. He is in a coma and his prognosis is not good. It is highly likely that he will die.

You have, Mr Hammond, along with so many at the FCO, been complicit not just in turning a blind eye to the fate of a citizen of the United Kingdom whom you know to be innocent of the crime of rape; you have been complicit it doing all you could to prevent Mr Fletcher from being given the fair trial he deserves and that he has been asking for close to five years now.

You are a disgrace, Mr Hammond, as are all those working for you that have been involved in this matter.

    My trust in the legal system both in Cambodia and UK aswell as in all 2400 registered NGO in Cambodia, particulary Licado which calls itself a Human Rights Defender has evaporated.

    All those western governments that support APLE, Thierry Darnaudet and it's many affiliates accept that Thierry Darnaudet when accused of child abuse in 2013 by Hang Vibol - Aple's former Country Director in Cambodia simply says the allegations against him are "unfounded" and at the same time deny David Fletcher and Matt Harland a fair trial.

    I believe now that many of those that orchestrated this scam will raise their champagne once David Fletcher is dead. At the same time the media which is equally guilty of supporting David Fletcher's suicide attempt by staying silent on the issue. They simply will post APLE's next child abuse report..... true or not !

  7. David Fletcher is a genuinely nice man who has a huge heart. All the promises that were made to him were not kept and broke this kind man. He was promised time after time by different organizations that he would have help or at least get an appeal. This last lawyer that David hired made promise after promise to visit him with the paper and a translator so he could view what was going to be said in an appeal that the lawyer said he could get. The lawyer even said that he had come to visit David in prison. That was a lie. He never showed up.
    David was in a hopeless situation. Help was offered in exchange for money and when the money was paid, they disappeared. This happened time after time. It was the last straw when he was let down once again by the lawyer. He gave him many chances and it was always a failure. I’m not sure what exactly is going on in this legal system, but it seems that if you have enough money you can get by with anything as long as you bribe someone. David Fletcher is not the only one in Cambodian prisons falsely accused and that is really disgusting.
    What a sad story for David Fletcher.

  8. Today I received an email from one of David’s friends that I have been in communication with. One of David’s many friends; one of those who knew him well – many of whom went to the dump with David and shared with him the experience of helping the families living there. Here is what this friend of David’s wrote:

    “It was a week ago today that David attempted to end his suffering. Like you stated, I hope that he is unaware of his condition.
    The fact that he is still alive tells all of us that he was a strong person..............perhaps if they had not of found him in time, the drugs would have worked.......little has been said about how they found him.........or how soon he got medical attention.......I am not sure that if he does wake from this that he will be pleased that he failed in his attempt.

    This was not something that David just did at the spur of the moment............he even gave the lawyer time to change his mind.............this hedged on the fact that the lawyer did not come for the visit that was supposed to happen.

    David saw this as a sign; if he showed up, David would carry on, if he did now show up, David would give up and take the midnight express.
    The lawyer did not show; David was a man of his word; No hope meant that he would seek freedom the only way he knew how.............he could not stand another day of hopelessness............prison with criminals who were more like animals than humans; it seems there was an ugly American that was gross and stupid............David had just reached his limit...........yet he was willing to endure more of the same if only the lawyer had of showed to give him just a spark of hope........

    Hope is something that we all need to survive........hope helps us deal with the times we have nothing else. David had lost that and could not see another way out.

    You mention that David's life was in the hands of he gods........I am one of his supporters that believes in ONE GOD and if David is in his hands then David is indeed in good hands; I have no clue what will become of all of this but as a believer, I know that God will in fact use David to help expose what has happened over there..........many of us who support David, have from the beginning, thought that you were a God send to David; I still believe that your chance meeting was not a chance at all......having said that, I now Pray that God will continue to guide the outcome..........best wishes James and those of us who know David are still hoping that what ever happens,,,,,,,,,,,,,,those who have done this to David will be exposed for their evil doings.”

    David had spent $6,000 on lawyers who did nothing other than take his money and run. The one that I had dealings with was surprised when I pointed out to him that amongst the documents he provided me with was the doctor’s report prepared for the court that declared Yang Dany to be a virgin. After a year of representing David he had still not read it!

    I happen to think that David’s current lawyer is a good man and has the best of intentions. It is unfortunate that he did not visit David as he had promised but there may be good reasons for this. Certainly, since David’s suicide attempt he has revealed himself to be a man of compassion. If David recovers I have faith that this lawyer will be able, if any lawyer can, to obtain for David a fair trial.

    1. I am curious---has anyone from the British Embassy been to the hospital to check on David Fletcher's welfare? I am guessing that they have not since they have never assisted David in any way in his quest for a fair trial. In fact, they destroyed his passport, which would have shown that he was not in Cambodia on the date of the alleged rape.

    Re" the David Fletcher case and others where there is evidence of APLE'S complicity in arranging with the corrupt legal system in Cambodia to have innocent men convicted the Phnom Penh Post remains mute.

    "yes they do get some bad guys sometimes" but to Thierry Darnaudet and Samleang Seila it does not matter at all, innocent or guilty. It is numbers of convictions that matter so they can then elicit donations. It is money that matters.

    That APLE destroys innocent men"s lives and tears families apart is immaterial to them.

    Many people around the world including some leading media organizations are being alerted to what is happening in Cambodia .

    What you and others working in The Cambodian Media are doing is a form of appeasement , not for political gains but for money and job security .

    History will judge you and others , when this tolerance and complicity of the holocaust of human suffering brought about by the corrupt NGOs in Cambodia ( Not only APLE) and to a large degree assisted by the 4th Estate is exposed.

    1. Agree with you Liam! NGO's should not be part of an unofficial police network to set up people for their own profits. What they do is a crime against humanity. Police should do the policing and children could easily understand who to go to if there is an issue.

      If I had to go back to prison in Cambodia I had planned to do what David did
      with an overdose of heart medicine.

      It was like my life had ended. One day I was a respected Lecturer at a University
      and had just been invited to join the Academic board and I lost it all. My family were my strength and then I lost my family as a result of the Phnom Penh Post’s lies.

      I was only in prison for two months. I was like a caged animal. Nothing can be worse more soul destroying than being accused of a sex crime (sexual harassment ) at 68 years old when you are innocent and never had a blemish on your character ever before.

      I am a proud man , the shock, the pain, and the events that unfolded afterwards
      by the lies in the PPP have destroyed what I have worked for and up until that time
      was so proud of had achieved in my life what I earned.

    3. The unnamed editor is Chad Williams - a man who has ignored all of Liam Miller's and my own requests, made several times now, to correct the factual errors made by the Phnom Penh Post in relation to Liam Miller's case.

      From a journalistic point of view Chad Williams has revealed himself to be a man of little or no professional integrity. He will publish what he sees fit. Whether it is true or not is of little consequence. And if an honest mistake has been made, as may have been the case here, will Chad rectify the mistake? No. And if this mistake plays a major role in destroying a man's life, does Chad care? No.

      Quite apart from the injustice done to Liam Miller there is the larger question:

      "How much of what we read in the Phnom Penh Post can we safely presume to be 'objective', unbiased, and how much has been influenced by the PPP's desire not to upset the likes of Scott's Neeson and the Cambodian Children's Fund and Action Pour les Enfants?"

If you can't beat 'em, join 'em. This applies to marketing gurus like Scott Neeson and human rights gurus like Naly Pilorge. And it applies to the so-called 'media' in Cambodia that is for sale to the highest bidder, just as the Cambodian judicial system is. This nest of greedy vipers make the American wild West seem like Mary Poppins. The truth will out eventually but by the time it does it will be too late for David Fletcher or for the children whose lives have been destroyed by NGOS that have removed them from their families so that they can use their poverty to garner donations from the rich in the first world who can then feel terrific and fulfilled for having helped some poor orphan.     For several years, David would phone me from Cambodia on Sunday mornings...........he was always telling me stories of the kids he was helping.

    His constant companion at that time was a girl he was very much in love with named Davey. I believe it was Davey who introduced David to feeding the hungry children.

    David spoke so proudly of the help he was getting from others for "his children". How he could turn a small amount of money into enough food to feed hundreds of kids..........he also found ways to get many of them medical attention.
    This was his calling.

    David was never as happy as when he was helping these kids.............and with Davey......he wanted for little more from life.

    I have known David since 1982: worked projects with him since 83; traveled with him on some great trips where we spent many hours exploring new places. David loved to travel and often spoke of the day when he would be able to retire and travel as well as enjoy a simple life.

    Prison is the harshest thing David would ever be forced to endure. The terrible conditions plus asking others for help. A heart breaker for such an independent man.......a man who is far more comfortable helping others then being helped.

    The people responsible for taking this away from him are simply put, "evil". Greed has driven them to these acts. They will no doubt smile every time they think about their acts...........but what they have done is deprive hungry children of the help David was so happy to be giving them...........they did not just put an innocent man in prison............they have forced children in need to go with out.

    The girl who accused David of rape and later admitted that he did not rape her is guilty of crimes against the children who have not been helped while David is in prison............this is a sin against not only God but man kind.

    I will never travel to that place...never give a penny to any cause that claims to help Cambodians.......when possible never buy any item made in Cambodia............just as I did this past Christmas............I looked at the label and passed on those items that said, made in Cambodia......

    My Friend sought his freedom by taking the midnight express.........the only way he could escape the nightmare he was living......who can blame him? But, God help those who are responsible for putting him in this situation.

    1. Would you like a box of tissues? What a load of one sided dribble. Like TL above - do you think Cambodia gives a flying hoot if you never travel there. Its probably for the best as the old saying goes, pedophiles always hang to together - so there is a good chance you are one yourself.
