# 186 A letter to Minister for Justice regarding Wu Chia Hsun, in jail since she was 16

During my visits to Mr David Fletcher in PJ prison I have met a young woman by the name of Wu Chia Hsun. She has been in jail since 2007, since  she was 16, for trafficking drugs.

Wu Chia Hsun was very young, very naive and acting on the orders of her father when she smuggled the drugs back in 2007.

In January this year she wrote a letter to the King but could not have it delivered to his office as she did not have the money to make the payment requested by those who were in a position to deliver it. Please read Wu Chia Hsun’s letter:

Dear respected and kind King

My name is Wu Chia Hsun. I come from Taiwan. I was born in 1991, May 3rd. I’m 25 years old. Im in PJ prison. My parents separated when I was 6 years old, and I moved to live with my granny in th4e country side.

My case number is 2093. My case is international drug trafficking. The date I was imprisoned was 2007, December 7th. The court sentenced me to 12 years. I was only 16 years old when I entered prison. I’ve been inside the prison for 8 years and one month without any family visits. And my sentence was reduced by 9 months during the Water Festival of year 2015. Now I still have 3 years and 2 months. I’ve already served 2/3 of my sentence.

Dear respected and kind King, I apologise for what I did! It’s a big mistake! I’m really sorry! I was too young. I was just trying to help my family. My family is very poor, and I’ve a bad father. He had a lot of credit money.  But if I had known the severity and serious consequences of what I was asked to do, I would not have done it. I was beknighted to believe a bad person. Because of my innocence I was incapable of accomplishing my own studies. I missed my important younger years and the destruction of my innocence.

Dear benevolent King, please forgive me, and please forgive my rudeness in requesting your help. Please help me be reunited earlier with my family and be obedient to my old granny and mammy. Please, I don’t have money for communication pardon I’m helpless. I feel helpless. I’m suffering here. I miss my family so much! I really want to go home! Please, I beg you dear respected and kind King. I promise I’ll always be a good girl. And I’ll always keep a kind heart! Thank you very much! I’m really appreciate your help.

If you were to send a representative of your Ministry to PJ prison, Mr Ang Vong Vathana , to speak with Wu Chia Hsun she (or he) would find that despite her now being 25 she is still the same very innocent girl who was doing as she was told by her father – in an attempt to pay off her father’s debts and lift her family out of extreme poverty.  Some discrete questioning about the circumstances surrounding Wu Chia Hsun agreeing to her father’s demand that she smuggle drugs would reveal information that she does not want to divulge in public. Shew does not wish to bring shame on her family. This information would go some way to explaining why she felt compelled to obey her father’s demand that she smuggle the drugs.

Yes, Wu Chia Hsun committed a crime in 2007 but is there any purpose to be served in keeping her in jail any longer? I believe, if someone from your ministry spoke with her, that they would realize she is not a criminal but merely a young girl who made a mistake and that she deserves to be released and allowed to re-start her life.

      During the 7 years she had been in jail not one person or organisation has advocated on her behalf. I met Wu Chia Hsun by chance and have made a very small gesture towards helping her. There is nothing more that I can do but at least I have done something.

      And why do you think she will serve her full sentence because I wrote a letter to the Minister? You really think I have that kind of influence on the Ministry of Justice?

      You are a liar. I work for the American Embassy. There is no American in PJ prison convicted of statutory rape. There is however an American serving an 18 month jail sentence for killing a Khmer man who attempted to rape his 11 year old daughter.

  7. steve Morrish is not the only person in the world with access to PJ, I have been there hundreds of times over the years and have visited with numerous people. what you fail to understand is that the rule of law is not subjective. it stands as it is because what will keep the next girl from using the same excuse? there is zero evidence to back up her claims, so whether true or not it would be inappropriate for any court to release her early. whats the difference between her and the aussie mother who got banged up for smuggling heroin? anyone who gets caught makes up every excuse possible why they are innocent, yet they never have any evidence, only inadmissible hearsay which seems to be your only source of information. what is to be served by keeping her in prison is a detterrent to anyone else who may think of smuggling narcotics in the future. the drugs she smuggled ruined peoples lives, same as the oz mom, everyone enjoys the benefits of their crime but not the punishments.

      If you are not Steve Morrish, who are you? Why do you feel the need to remain anonymous?

      If you have been to PJ hundreds of times and have visited numerous people you know how the system works. I have only been a few dozen times but one only needs to go a few times to realize that the administration of justice in Cambodia is almost entirely subjective. If you have money you can get yourself out of jail. If you don't have money you can't. If you have money you can get someone else put in jail of fabricated charges. You know this.

      I have been told that I would have to pay 'big money' to get David Fletcher out. I spoke with someone the other day who was told that he would have to pay a lot of money for an early release. Another prisoner I have spoken with said that she was told she would have to pay $250,000 to be released. She is non-Cambodian and the presumption is that she must be rich (or her family is rich) and so can pay. He co-accused (same crime) is Khmer and has been told that she must only pay $100,000 to secure her release. And so it goes. And you know it, so don't talk about the legal system as though it operates in accordance with the law. Even to get a letter through to the King’s office costs money. You know this. To get a letter placed on the minister’s desk costs money. You know this.

      Wu Chia Hsun was 16 when she committed her crime. She was just a child. Yes, she made a mistake but if you were to talk with her (and it is clear that you have not) and heard more of her story, you might, perhaps, be a little more compassionate. And if you were to talk with her and realize how young she is, despite being 25, you would appreciate just how young and innocent she was when she did her father’s bidding.

      As for drugs ruining people's lives, what about alcohol? Alcohol destroys more people's lives than all the other drugs put together. Drug abuse and alcohol abuse are both health issues that need to be addressed as such. The last 50 years of the 'war on drugs' has had zero impact on the problem of drug abuse and yet you, and so many others, still talk about the jailing of drug smugglers as a deterrent. It clearly is not. Illegal drugs makes criminals very rich and all those who benefit from the illegal earnings of these criminals. Keeping drugs illegal feeds and breeds corruption.

      If Steve Morrish did not make the factually incorrect comment about the American in PJ prison for statutory rape, he is quite free to say so here and attach his name to it.

      If Steve did make the comment then he is lying. There is no American in PJ prison on charges of statutory rape.

      As for whether or not Steve is impressed, I could care little. And congratulations on sending Steve a copy of the comment. What a hero you are.

      On the 'false material' point, name me one example of where I have placed 'false material' here on this blog. Or two examples. Or as many as you like. You won't do this because you, like all members of Team Neeson, have no interest at all in facts that can be disputed. You just want to make broad statements that have only one purpose - to shoot the messenger.

  9. If Ricketson had any credibility or was respected at all by any Government person in any country, then perhaps a letter from him to the Minister of Justice might carry some weight. But the fact is that Ricketson is considered a pest, a vexatious complainant and as soon as anyone sees any correspondence from him, it is treated with the contempt it deserves.

      You are right about one thing - I am considered a pest by those who do not like to have their dirty linen washed in public. Scott Neeson is one such person.

      Before I started advocating on behalf of Mr Fletcher's right to a fair trial, there was no-one doing so and he would have died in jail. As a result of my advocacy he will now, at the very least, have a Supreme Court hearing. This was acquired, amongst other things, by writing several times to the Minister for Justice.

      There are two possible ways of looking at your statement here:

      (1) You are unaware that Mr Fletcher has lodged all the papers and that he has a Supreme Court case number.

      (2) You are aware of (1) but are actively engaged in seeing to it that the Supreme Court hearing is never scheduled.

      This would be very convenient for both Scott Neeson and for Samleang Seila because the last thing that either of them wants is for Mr Fletcher to have a trial that is open to the public and the media. Both have a great deal to lose if evidence is presented to the court not only of Mr Fletcher's innocence but of the complicity of various individuals and NGOs in his pursuit, persecution and prosecution in a secret trial.

      But let's just say you were right (and you are not) and the matter was finished, what does it say about you that you would deny a man (any man) a fair trial? Cambodia certainly seems to attract more than its fair share of the dregs of the 'developed' world - men who take delight in the suffering of others and who care not at all for justice.

I'm a female and I find it extremely creepy that Ricketson advocates for a child sex offender, that he visits very poor families with young children and now he has befriended a young girl in prison, who to Ricketsons own admission, is simple and very gullible.       What is 'creepy' about anyone advocating for another persons right to a fair trial? Do you think that accused sex offenders, accused murderers, men or women accused of any crime at all are not entitled to a fair trial? How about the Khmer Rouge cadres? Are they entitled to have lawyers advocating on their behalf or would you find it 'creepy' that I or anyone else (like a lawyer) would advocate their right to a fair trial?

      And why is it 'creepy' that I should be helping poor families out by the rubbish dump - families that include babies, grannies, a man in a wheelchair, mums, dads, teenage boys and girls etc. An entire community of people. And this is 'creepy'? Please explain why this is so?

      As for the young woman in prison (25 years old) did I ever say she was 'simple'? Yes, she was very gullible to have agreed to help her father as she did but there were circumstances that she wishes to remain private that also spurred her decision-making. In any event, if I were the predator you are implying that I am, why would I chose a 25 year old women who is in prison and who will probably be there for the next three years?

      So, the answer to your question is, "No, I am not a predator." You can believe me or not but if it is a matter of concern to you or anyone else do your research, ask around, file a complaint, start a blog, fire questions at me. This is all fine by me. I will answer your questions.

      Rachel was someone who used to comment quite a lot here. Her tone was similar to yours except that I can see, from this last comment of yours, that whilst Rachel and I disagreed about various things, we cold actually engage in a dialogue.

      As for my always being correct please do me the courtesy of pointing out to me one, two or three instances you are referring to and I will address them. You will not do this because, like all members of Team Neeson (even if you are only an associate member) you like to make generalised statements that can't be challenged but never specific points that could be challenged or which could be the starting point of a dialogue. You could, for instance, write, "James, how are you so certain about such and such..." to which I would then be obliged to reply with the evidence I have, the facts that I have at my disposal. If you then challenge my facts, my evidence (as you should) I am then obliged to either concede that I was wrong or seek to demonstrate that I am right. This is called dialogue. Civilised dialogue. People in the real world actually engage in this quite a bit. On social media, however, people such as yourself and so many others, have no interest in dialogue.

      I was convicted by the Phnom Penh court in absentia, with no opportunity to present a defence, for the non-existent crime of "threatening to dishonour Citipointe Church." This is the church that illegally removed children from their family and kept them for sex years contrary to the express wishes of the parents. In Australia, in any country in the world where the rule of law applied, Pastor Leigh Ramsey would have been charged with kidnapping. Even in Cambodia.

      The relevant law, Alan, is as follows:

      Law on Suppression of Human Trafficking and Sexual Exploitation

      Article 8:Definition of Unlawful Removal

      The act of unlawful removal removal in this act shall mean to:
      1) Remove a person from his/her current place of residence to a place under the actor’s or a third persons control by means of force, threat, deception, abuse of power, or enticement, or
      2) Without legal authority or any other legal justification to do so to take a minor person under general custody or curatoship or legal custody away from the legal custody of the parents, care taker or guardian.
      Article 9: Unlawful removal, inter alia, of Minor

      A person who unlawfully removes a minor or a person under general custody or curatorship or legal custody shall be punished with imprisonment for 2 to 5 years.

      Other than this,the last conviction I had was in 1971, after I was arrested for protesting against Apartheid in South Africa.

      Just answer some questions, Alan, since Scott won't. You have as little credibility as he does but are, of course, a beneficiary of the various scams CCF is involved in - World Housing being the most glaringly obvious one.

The questions remain: "Why did you tell the world that you were giving $1 million in free housing to poor families when you were 'gifting' this million dollars to yourselves?"
