You are all former police officers and familiar with the notion that a person accused of a crime is presumed to be
innocent until proven guilty.
I have a few questions for you:
Do you believe that an accused person can
be deemed to be guilty if his (or her) trial was held in-camera (in secret); if
the defendant was absent from the proceedings; if he/she was unable to present
evidence to the court or have a lawyer cross-examine witnesses for the
prosecution?
If your answer is ‘no’, the next question
is:
Do you believe that Mr Fletcher’s trial in
Cambodia in 2011, held in ‘in camera’ and with Mr Fletcher unable to present
any form of defense, was a fair trial?

For the past two years, the British Police Child Exploitation and Online Protection team (CEOP), in cooperation with the Cambodia National Police and NGO’s South East Asia Investigations into Social and Humanitarian Activities (SISHA) and APLE have been investigating British national Mr. David Fletcher for alleged sexual abuse of children in Cambodia. On Wednesday the 23rd of June 2010, media articles were published in Cambodia and other countries which alleged that Mr. David Fletcher, a British national living in Phnom Penh, was running a not-for-profit organisation which provided food and medical services to children living in the Stung Meancheay dump site in Phnom Penh. The media articles further alleged that Fletcher was sexually abusing young children living at the dump site. On Friday 25th of June 2010, as a result of media articles published, Fletcher fled Cambodia and travelled across land into Thailand. The British Police Child Exploitation and Online Protection team (CEOP), in cooperation with the Royal Thai Police and NGO - South East Asia Investigations into Social and Humanitarian Activities (SISHA), acting on information provided by concerned citizens living in Cambodia, located Fletcher at a guest house in Bangkok.
It should be noted that:
(a) In this press release there is no mention of Mr Fletcher being wanted for rape.
(b) Mr Fletcher was never charged with “sexually abusing young children living at the dump site”.
(c) This press release was written 8 days after Yang Dany had been quoted in Andrew Drummond’s article as referring to Mr Fletcher as her ‘fiance’ and as a ‘good man’.
(d) After “two years, the British Police Child Exploitation and Online Protection team (CEOP), in cooperation with the Cambodia National Police and NGO’s South East Asia Investigations into Social and Humanitarian Activities (SISHA) and APLE” had found no evidence that Mr Fletcher had either groomed young girls (Neeson’s allegation) or that he had raped anyone.
(e) It would be more than 2 weeks after his arrest in Thailand (no charges ever laid) before Yang Dany accused ‘fiance’ and ‘good man’ David Fletcher of having raped her twice, 15 months previously.
(f) In Sept 2010 CEOP, SISHA and APLE learned that Yang Dany remained a virgin after two ‘brutal rapes’ that lasted, according to her statement to the police, for an hour each.
(g) No-one from CEOP, SISHA or APLE expressed any concern that Mr Fletcher may not, as the medical evidence suggested, have raped Yang Dany.
(h) CEOP, SISHA and APLE were quite happy for Mr Fletcher to be tried in-camera (a trial closed to the media and the public) and with Mr Fletcher not informed that the trial was taking place and unable to present a defense.
(i) CEOP, SISHA and APLE have no problem, to this day, accepting that Mr Fletcher was found guilty of rape in a court case that breached pretty well every part of the Cambodian Code of Criminal Procedure.
(j) CEOP, SISHA and APLE refuse, in late October 2015, to advocate Mr Fletcher’s right to a trial held in accordance with the Cambodian Code of Criminal Procedure.
James s, you alluded previously to someone using a 'fake email address' that may have set David up by reporting David's Thailand location to the Bangkok Police. It still must have taken some connections to get David arrested,when there were no charges. Would it have been someone working closely with CEOPS??

This person, whose identity I am pretty sure of, had established email contact with Mr Fletcher and offered him a job in the Philippines. he was the only person who knew where Mr Fletcher was staying in Bangkok and led the Thai authorities there. the Thai authorities, acting on behalf of Cambodian authorities, arrested Mr Fletcher. No charges were laid because Mr Fletcher had not, at the time (late June 2010) broken any law in either Cambodia or Thailand. However, having Mr Fletcher held in jail until Cambodian authorities found something to charge him with was not a problem. And, 17 days later, Yang Dany managed to realise that Mr Fletcher was not a good guy after all but had raped her 15 months previously. The fact that APLE kept badgering her to remember more clearly what had happened had no bearing on what she subsequently remembered. And that offer of $30,000 in compensation? This had no impact at all on Yang Dany's clear recollection of being raped in March 2009.

DeleteOn the basis of what I know (and it is a good deal) Morrish is in the clear as regards arranging for Fletcher to be arrested in Thailand. CEOP and the British Embassy are not.
However, it needs to be borne in mind that in late June 2010 the British embassy had good reason to believe (thanks to Neeson's defamatory comments to Drummond) and Morrish's allegations that Fletcher had been sexually abusing children, to act as it did. The British Embassy had no reason to doubt Neeson's or Morrish's allegations.
However, once the British Embassy began to have doubts about the validity of the charges laid against Fletcher (when it discovered that Yang Dany was a virgin) it could have, and should have, distanced itself from the case and made known that Mr Fletcher was entitled to a fair trial. it did no such thing. The British embassy continued to play an active role in the case, as is evidenced by the fact that it arranged for Mr Fletcher's passport to be destroyed.
The British embassy (and other embassies) go through the motions of not interfering in the internal affairs of other countries but this is all smoke and mirrors. Controlling the purse strings to aid dollars the embassies can choose to get involved behind the scenes or choose not to. In this instance, the Foreign & Commonwealth Office jumped the gun and got involved in the Fletcher case until it realised that it had cocked up and then, having destroyed evidence, decided to extricate itself and leave Fletcher to his fate, knowing full well that the case against him was flawed. To have acknowledged the flaws would have necessitated that the FCO admit to its own active involvement in the case. Not only would this lead to egg on the faces of several highly placed FCO bureaucrats, it could also lead to heads rolling and to court cases in the UK if Mr Fletcher were to leave jail alive and innocent.
The FCO has a vested interest in Mr Fletcher dying in jail. The same applies to various others who would be horrified by the prospect of a fair trial in which Mr Fletcher could be found to be innocent.

DeleteIf true that would seem to be a tacit acknoweldgement that Ricketson is right - that Fletcher was railroaded for something he didn't do because the "professionals" weren't able to gather sufficient evidence to charge him with something else, or weren't able to charge him with what they thought he deserved. It would make sense of Pilorge's comment that she has been shown evidence of his wrong doings, and of the various 'insider' claims that they knew he was up to some sort of no good with kids, which wouldn't surprise me if true about Fletcher, but it still suggests that Fletcher was railroaded, and the system corrupted to insure a conviction.
After two years of investigating these guys had to come up with something or they’d look fucking stupid. It took a couple of weeks and the promise of $30,000 to get Dany to scream rape but when she did all their Christmasses came at once. Bingo. Fletcher’s fate was sealed. Fuck him. The last thing theyd want now is a fair trial. Fuck, what if he gets off! We’ll all look like fucking idiots and corrupt for having railroaded him. These guys, whose continued funding is dependent on catching pedophiles, would have no reason at all to set up Mr Fletcher to keep their arrest and conviction rate up! They are upright cops and the business about Mc Cabe setting up drug stings is just a little misunderstanding, right? Right. Phew. For a moment there I thought these one-time cops might have a credibility problem. Not at all. They want to see justice done and, well, the Fletcher case is a bit embarrassing but in the grand scheme of things does it really matter if Fletcher rots in jail. Many comments being aggressive because some do not listen and quick to judge. Gaughan criticized Van Gough for painting too fast, Van Gough replied, you look too fast!
The first criticism was Fletcher cannot make up his mind how long he has been in Cambodia! They looked to fast.
Next criticism was because I was trying to Clean up street 136, it was filthy! I was accused of trying to be mayor of the street, simply because I posted the mechanics of the project honestly and wanted the street to be attractive to tourists. Most would say a sound business idea, not so on khmer440!
When I speak of khmer440, I am referring to Hogan days, I understand there are now new owners as Hogan is busy in warmer climes. Hopefully the new owners are more professional than Hogan, not bigots, I would like to think so. Hogan banned my right to reply long before James was banned. Hogan did not like honest, factual replies and he compounded the unsubstantiated opinions that suited him, without researching the facts as James. If khmer440 has higher standards now, I wish them well.
I am as James, I do not believe in censorship, but are as racist, again my views have been misconstrued by the too fast lookers. I believe in censorship against profanity and offensive remarks, bad manners and zero courtesy, sadly in retaliation I have stooped to these levels at times, it is my nature, I am ashamed to admit. It's the same as the racist situation. I am racist against any person who is rude, lacks any standard of behavior, courtesy and consideration for others. Another point that is poorly used as criticism and name calling. I agree with you that you criticize my poor education. It is poor and I envy those that have been fortunate enough to have far better than mine. But if you are as educated as you claim, you are well aware that intelligence and I.Q. have nothing to do with education. I applaud a good education has been available to you, my parents were not well off, but they were good parents. When I was at school the level of teaching was very poor, and in the so called good old days, free uni's and further education was not available without paying for it. I focused on making more money than my parents and a better standard of living for my future wife and children, maybe I was wrong and should have focused on more education. But, I know some academics with far higher education than most on these blogs, they are unable to get work or earn a decent living. I have never been out of work, have always worked for myself and made a good living honestly. I often wonder by the tone of some of the remarks by some bloggers of their status quo.
Some are critical of me writing a book and claim I am fantasizing, you do not know what you are talking about as usual , but it suits your vicious agenda.
My book is a biography of my life in Cambodia, the love, the discovery, the experiences, if you read books, a big if! Do you shoot down a biography because hard proof of every sentence is not available? No!
My book is my effort, clumsy it may be, but honest and outspoken as its author. I name you all and your agendas. How many of you had an interesting enough life to write about? And if you have, how many of you have got off your barstools and actually achieved writing a book?
I was taught, as in love, it is better to love and lose, than not have loved at all. I was also taught in my humble upbringing that it is better to try and fail, than not try at all!

One of neeson's goons said I was stupid or something to that affect for saying that it was a crime against the children as well as David. It does not matter to me if people think it naïve to think of how much the children lost when David was put in prison.............and as of this date, no one has stepped up to help them.

DeleteI have never believed anything Mr Fletcher has told me if it was not backed up with facts. When Mr Fletcher told me that he had not raped Yang Dany I took his pronouncement with a grain of salt. WHen I discovered that Yang Dany was a virgin after the alleged rapes, I began to think he might be telling the truth. Then I tracked Yang Dany down and she said she had not been raped. ANd her mother said likewise. They had been told there was $30,000 waiting for them if Mr Fletcher was found guilty of rape. Then I discovered that the trial was held in secret and that Yang Dany did not make her rape allegation until Mr Fletcher had been in a Thai prison for 17 days.
These verifiable facts led me to believe that Mr Fletcher was (and still is) entitled to a fair trial. If there is evidence of which I am unaware that he is in fact guilty of rape and if he is found guilty on the basis of thart evidence, I would fully support the verdict. My point is, and always has been, that Mr Fletcher - like yourself, myself and any other person who might be accused of a crime - is entitled to a fair trial. In Cambodia this means a trial conducted in accordance with the Cambodia Code of Criminal Procedure.
I am mystified as to why anyone would wish to deny him (or anyone else) this right.

ReplyDeleteI heard a little whisper last night that the Cambodian Ministry of Justice is planning on submitting a defamation case against Ricketson for his constant accusations that they are corrupt. Hope you have sold proof Ricketosn showing that the Judges have been corrupt or you will be in hot water. Hahaha I knew it would come eventually. And lets see Ricketson if all the keyboard warriors who egg you on whilst typing anonymously will be brave enough to come out and assist you publicly when you find yourself jailed. I can hear the fat lady singing and laughing. The moral of the story is "if you tease a rattlesnake long enough it will bite you' - good luck ricketson - hope you have a good Khmer lawyer.

DeleteRather telling that the anti-Ricketson crowd would be cheering the possible illegitimate use of defamation laws by Cambodian authorities to silence somebody who spoke a commonly held truth about the Cambodian judiciary. It is indicative of their whole M.O. really. When they can't get what they want by legitimate means (whether it is Ricketson to shut up or Fletcher imprisoned on insufficient evidence), they readily encourage the corruption of the system to get it by other means.

Ricketson could be considered by many as one of the most evil pricks that has ever walked the planet in his quest to protect a convicted sex offender (in 2 countries).

If Lemon did say this, yet another piece of the jig saw puzzle falls into place. It means that CEOP, SISHA and APLE were sharing their information with CCF.
The problem with this (quite apart from the questionable professional ethics involved) is that when Mr Fletcher was arrested in Thailand, thanks to the British Embassy, CEOP, SISHA and APLE had no evidence at all that Mr Fletcher was a 'kiddie fiddler'. They had all been looking for 2 yeas but had come up with nothing. They had not even been able to convince Yang Dany to make such an accusation as yet. This would come 17 days and the promise of $30,000 'compensation' later.
So where did Lemon get his 'kiddie fiddler' information from? Had he and Neeson cooked it up, knowing that CEOP, SISHA and APLE were looking for just such evidence to nail Fletcher with? Or did APLE feed this 'kiddie fiddler' observation to Neeson and Lemon, knowing (or at last suspecting) that Neeson would leap on it as an opportunity to get rid of Fletcher? The assistance that Mr Fletcher was giving to dump families was, after all, attracting a lot of media and other attention that Neeson thought was rightfully his.
Regardless of who put the 'kiddie fiddler' idea into Neeson's head, it played to APLE's advantage when Neeson told Drummond that Fletcher was 'grooming' young girls. APLE knows that these are just the kinds of stories that journalists love. Everyone hates pedophiles so getting pedophile story into the press is bound to get APLE's brand out there in the public eye (again) and serve the secondary purpose of guaranteeing that the person branded as a pedophile does not get a fair hearing in public. ANd APLE can rely on certain newspapers to print whatever press release they put out so its a win win for APLE: great publicity to convince sponsors and donors that APLE is doing a great job and the alleged sex offender essentially tried in the court of public opinion before there is any court case.
So, did Neeson come up with his 'grooming' comment all by himself or was he groomed by APLE with false information which he very helpfully passed on to Drummond. I do not know the answer to this question but clearly Alan Lemon, Scott Neeson and Samleang Siela do. None of these three is likely to answer the question.
So, ear Reader, keep your eye open for the next APLE success story. There will almost certainly be a photo of the alleged sex offender being arrested. If APLE can manage it there will be a film crew present also. ANd there will be the press release which essentially defames and pre-judges the person arrested. The Phnom Penh Post and Khmer Times will do a cut and past job on the press release and call it news. ANd if, at some later point, they discover that it was factually incorrect,they will excuse themselves with: "We were just reporting the news."
Despite APLE's manipulation of the media the man arrested may well be guilty. On the other hand, he may not be. I don't think APLE cares one way or another. Yes, it's preferable to catch a real pedophile but if there isn't one around and its been a while since APLE has been able to prove to donors and sponsors that it is doing a good job, anyone with the right profile will do. It has been suggested by one genius Team Neeson Troll that I look like a pedophile, so perhaps APLE could go after me next and kill several birds with one stone!

This has nothing to do with whether or not they think he is guilty; whether or not they like/dislike him. It is a fundamental question of law.
There will be others to whom I ask the same question. I am curious to know who is genuinely committed to the rule of law and whose commitment is contingent.

Morrish was intimately involved in the Fletcher case.
Lemon and Mc Cabe are involved with the Cambodian Children's Fund Child Protection Unit which, amongst other things is involved in the pursuit and prosecution of men accused of crimes similar to those Mr Fletcher has been accused of.
I have been asking a variety of people this question about Mr Fletchers right to a fair trial for a year now, including Director of LICADHO, Naly Pilorge, President Dr Kek Pung, representatives of Britain's Foreign & Commonwealth Office and others. My questions are valid.
As for my 'stupid questions', is it 'stupid' to ask James Mc Cabe if his wife was 15 or 16 when he first entered into a relationship with her? It is relevant because a part of his job is to conduct investigations that lead to the arrest of men who have sex with 15 and 16 year old girls.
There are, of course, many other 'stupid questions' I have been asking. For instance, why doe the Cambodian Children's Fund talk about 'gifting' homes to poor Cambodian families when it is doing no such thing? Why does CCF lock families out of their homes for being $12.50 behind in their rent? Why does CCF refuse to allow parents who enter into a contractual arrangement with the NGO
to retain a copy of the contract? Why does CCF not return children to their families when requested? How can CCF claim to be spending $4,000 per child in residential care (accomodation and education) when these children sleep 2 and 3 to a bed; sometimes 4 to a bed and often on the floor? Where and how is this $4,000 per year per child being spent? And why is it that the families of these kids in care receive, in rice support, only $250 a year.
The questions go on and on. All of them stupid in your view.
As for your 'jealousy' jibe, let me ask you a question:
I spent six years (a few of them on a blog) advocating for materially poor parents whose two oldest daughters had been illegally removed from the family by Citipointe Church's 'SHE Rescue Home'. Was I 'jealous' of these criminal Christians?
Really, Anonymous 11.08, strange as it may seem to you, there are people in this world who believe in he rule of law and are prepared to advocate on behalf of those who do not, realistically, have access to the law (many impoverished Cambodians) and those who have been denied access - Mr Fletcher.
It took six years but justice prevailed in the case of the poor parents mentioned here. Citipointe returned their daughters. I hope that it does not take six years for Mr Fletcher to be granted his only wish, and the only thing I have been advocating - his right to a fair trial.
Yes, point proven I think James, you will do anything you can to bring those you are jealous of into the limelight so you can have another crack at them. Back to the question - what are photos of either James McCabe and Alan Lemon doing on this post (apart from serving your purpose to try and have a go at people that are doing much more for kids in Cambodia than you ever will do)

Fundamental to their training as policemen are two several precepts, two of which are:
(a) Acting in accordance with the laws of the land
and
(b) A person charged with a crime is innocent until proven guilty.
Any disagreements so far? No? Right, then lets move on.
Neeson's comment about Mr Fletcher 'grooming' young girls was defamatory if it cannot be backed up with evidence.
Neeson has no evidence.
Wearing their 'former policemen' hats Lemon and Mc Cabe should find Neeson's 'grooming' comment reprehensible. It seems they do not. In the oral universe they inhabit their boss can say what he likes about Neeson. If Neeson's defamation of Mr Fletcher plays a significant role in his being jailed for 10 years, this is not a problem for Lemon and Mc Cabe.
But let's give them both the benefit of the doubt. Let's say that they both believe, in their hearts, that David Fletcher is guilty of rape. Should they not, nonetheless, grant that he has the same right to a fair trial as men and women accused of genocide? The evidence against these Khmer Rouge cadres is overwhelming and yet, quite rightly, they are deserving of a fair trial.
If they are so deserving, why is Mr Fletcher not deserving?
In their capacity as former policemen, if they are serious about the rule of law, they should have no problem with the idea of advocating Mr Fletcher's right to a fair trial.
They are clearly not going to do that. Nor is Scott Neeson. Their silence, along with the silence of many others, reveals the shallowness of their commitment to the rule of law.
They are not alone. There are plenty of others who should be committed to the rule of law whose commitment only extends to those whom they think to be deserving.
Alas, Cambodia is awash with non-Cambodian's whose commitment to the rule of law does not extend to men accused of sex crimes or to children illegally removed from their families. This raises a whole host of questions not to be delved into here.
There is the key - you have sent 6 years advocating for poor people in Cambodia and look what you have to show for it - a blog site that criticises and looks to discredit peel are successful in helping others less fortunate. Neeson has created a multi million dollar organisation that helps numerous people in the community, builds houses for the poor, provides education, food and medical services, Morrish created an organisation that assisted raped children and McCabe is now building unit that helps sexually abused children. Jealous of their accomplishments - you bet ya - it is so obvious that you are just a jealous bitter person Ricketson and you hate it it that you will never be able to follow in the footsteps of these good people and you hate it that they won't give you 5 minutes of their time to answer your bullshit questions. One thing is for sure - most people can se who the fool is here!

But no, Ricketson wanted to get some ratings for his blog so he decided to start defaming people and calling everyone from NGO workers to police to government to judges corrupt and involved in a conspiracy. Rickets decided to make such a prick of himself that he has actually made the powers at be very angry and has ensured Fletcher will not be released from prison until he finishes his sentence. Fletcher's case was dead in the water before I came along. There was no-one (let me repeat that, NO ONE) advocating his right to a fair trial.
Not only had he been abandoned by his own government, the British Foreign & Commonwealth Office had destroyed his passport in order to provide yet another obstacle to his receiving a fair trial.
LICADHO was not only unprepared to advocate his right to a fair trial, its director Naly Pilorge was, like Scott Neeson, defaming Mr Fletcher be saying ()by implication) that she was in possession of information that led her to a different 'finding',to the one I had arrived at. I had not, in fact, arrived at any finding but Ms Pilorge is clearly implying that Mr Fletcher is guilty. Ms Piloorge will not share her evidence with anyone - not even the Cambodian authorities. She, like Scott Neeson, does not feel the need for evidence of guilt to be tested in court. ANd Ms Pilorge heads up a human rights organisation!
The Phnom Penh Post totally ignored Mr Fletcher's case and was happy (and remains happy) to do public relations for both APLE and CCF.
The Cambodian judiciary had (and has to this day) no interest at all in allowing Mr Fletcher a trial held in accordance with Cambodian law.
So, what do you think a Khmer lawyer, working quietly behind the scenes, without access to 'big money' would have been able to achieve if
Nr Fletcher had had money to pay such a person?
Steve, let's get real here. If the "powers that be" are "very angry" and that my advocating on his behalf has "ensured Fletcher will not be released from prison" is this not corruption? The question is: "Is Fletcher guilty of rape or not?" Not whether I make the powers that be angry by beinbg quite vociferous in my advocacy.
You know well that regardless of guilt or innocence the bulk of verdicts arrived at by Cambodian courts have little to do with evidence, facts or the truth. If The Minister for Justice wishes to sue me for making such a bleedingly obvious observation (do a google search), so be it.
If some readers see me as a 'delusional fool', so be it. If others see me as a 'cunt', so be it - though this epithet, applied to a man, has always confused me!
I hav enbot yet been able to secure for Mr Fletcher a fair trial. And maybe I never will. But at least now there is a sliver of hope for Mr Fletcher - where no such sliver was there before I arrived on the scene. You, Scott Neeson, Naly Pilorge, the Phnom Penh Post were quite prepared to let him die in jail without having even been granted a fair trial.

ReplyDeleteAs always when dealing with Team Neeson, logic is not a strong point in the way you argue a case.
Firstly, as I have stated here time and time again, with this blog I am wearing my journalist's hat. I am not wearing my (for want of a better word) 'philanthropist's' hat. So my philanthropy, or lack of it here, is of no relevance.
The six years I was referring to was my advocacy on behalf of 2 young girls and their parents. It took 6 years to get the girls returned to their family - through my work as a blogger/journalist. As with Neeson I asked a lot of questions of Citipointe church that it could not answer honestly - just as Neeson cannot and will not answer honestly any questions put to him. The church threatened me in all sets of ways, took me to court but when it realized that intimidation was not going to silence me and when it's funding began to be affected by sponsors and donors who smelt a rat, the church, with undue haste, returned the girls it had illegally removed and detained. The family is back together.

In my first encounter with Neeson, years before I learned of the role he played in the jailing of Mr Fletcher, I was asked by the parents of two other young girls if I could help them get back their daughters. They had been resident in CCF dormitories for a few years whilst their parents worked in the rubbish dump. I had done a good deal of filming with the whole family in the dump and when Neeson offered to help out I thought this was a terrific idea. The two girls attended school at CCF, were well fed and cared for, learned how to use computers and returned one day a week to the dump to stay with their mother and father in the shack they lived in on the dump.

Then some cracks began to appear in this apparently ideal scenario. The sisters were, for some reason (different ages, perhaps) separated. Put into different institutions. And the older girl became sullen and uncommunicative and seemed, to me, to be suffering from depression.

ReplyDeleteIt was at about this time that the mother and father asked me if I could help them get their children returned to their care. Neeson refused to do so, citing a 'contract' he claimed they had entered into with CCF. The parents insisted they had signed no such contract. Neeson refused to produce the contract. And that is where it ended. That is when I realized that Neeson's help for poor children in CCF care does not extend to the rest of the family and that he seeks to take complete control of the children and then intimidate parents into acquiesce and silence by telling them that the contracts he got them to apply their thumb prints to give CC control that usurps that of the parents.
I expect the usuall kicking and screaming from Team Neeson but none of it will address CCF's use of bogus 'contracts' to control both kids and parents. Ask Neeson to make public the content of his contracts with parents and see what happens. Ask him to produce copies of the non-disclosure contracts that staff are forced to sign forbidding them from speaking to the media.
I must, alas, stop here for a while and address other commitments in my life.
