Mr Samleang Seila
Last night two men appeared in the foyer of
my hotel claiming to have a document to present to me from yourself.
The men identified themselves as policeman but
were not in uniform. They made no attempt to prove that they were policemen by
showing me badges or any other form of identification.
At first I refused to take their document but
then curiosity got the better of me and I indicated that I would take it. The two
men just stared at me and remained seated in the foyer for another 20 minutes
before they left, with the document.
If this was just a crude attempt at
intimidation, it has not worked. If indeed these two men were policemen please
ask them to return to my hotel in uniform or in a position to identify
themselves as police. I will accept their document.
Given the very real possibility that APLE may
be wishing to use the Cambodian judiciary to silence me, let me quote from one of
my blog entries of earlier in the year; an article published in the Cambodia
Daily the day after APLE had successfully blocked Mr Fletcher’s appeal.
San Sony, a lawyer from anti-pedophile NGO Action Pour
Les Enfants (APLE) who is representing the victim, and Hing Bunchea, the Appeal
Court prosecutor, urged the judges to disregard Mr. Fletcher’s claims and focus
solely on the fact that he had missed the deadline. “The time to appeal has
passed,” Ms. Sony said. “The defendant is just making excuses.”
Outside
court Monday, Ms. Sony conceded that the doctor’s report suggested Ms. Dany was
not raped but said the facts of the case were irrelevant at this point.
“I deny to focus on this fact of the case because my
director…didn’t allow me to,” she said. “This case only involves procedure.”

Facts irrelevant to David Fletcher rape case says APLE lawyer
So there
you have it Seila. You instructed your lawyer to ignore evidence, facts, and to
focus only on procedural matters. Your
concern is not with Mr Fletcher’s guilt or innocence. It is with keeping him in
jail at all costs. If Mr Fletcher should die in jail, having never received a
fair trial, this is of no interest or concern to you.
Your lack
of interest in Mr Fletcher’s actual guilt or innocence speaks volumes
of the moral code you live by and the
way in which APLE operates.
If you
wish to stop me from being critical in public of APLE’s modus operandi, demonstrate
your belief in the rule of law and stop thwarting Mr Fletcher’s attempt to
receive a fair trial. Right now his best hope of receiving one lies with the
Supreme Court.
If you
believe that you have a strong case that Mr Fletcher raped Yang Dany, advocate
in the Supreme court his right to a fair trial. Write to the Minister of
Justice requesting a Supreme court hearing as soon as possible. Bring Yang Dany
back from China. Present your evidence in support of the rape charges in an
open court. Allow Mr Fletcher to present evidence in support of his innocence
in an open court.

in which I ask questions regarding the role APLE played in the conviction of Mr
David Fletcher for the rape of a young woman whom you knew, as early as
September 2010, to have ‘survived’ two ‘brutal’ rapes with her hymen intact; a
young woman who denies that she was raped; a young woman and her mother whose
decision to charge Mr Fletcher with rape was made after they had been told they
stood to gain $30,000 in compensation if they did so.
You, Thierry Darnaudet, APLE in general have
consistently refused to answer any questions relating to this case – one in
which many questions arise pertaining to the honesty and integrity of APLE.
It is time for this nonsense to end, Seila.
Pursue pedophiles, collect evidence and have them prosecuted in accordance with
the law, but stop thwarting men like Mr Fletcher’s attempt to be granted a fair
trial.

APLE has no interest in fair trial, only persecution at all costs. Their actions on this case is reprehensible, as it is on the parts of human rights organizations! They are truely a low life group with zero credibility, run by low life's and operating in one of the few places in the world where they can get away with it.

DeleteWhen someone knows a person has spent five years in prison for a crime they did not commit, then they go to court to keep that person in prison on a technicality, for which the inmate was not responsible, that is the perfect definition of EVIL at its worst. That is beyond my comprehension. I hope they will have a heart and correct this egregious act before their bad karma takes care of them, as it has for others who were a party to Mr. Fletcher's false imprisonment.
ReplyDeleteSamleang Seila and Thierry Darnaudet knew, in Sept 2010, when they received the medical report declaring Yang Dany to be a virgin still, that the liklihood of his having raped her was very low. And yet they pursued Mr Fletcher. Why? Because he was a valuable 'scalp' to have to prove to donors and sponsors that APLE was doing a good job and in need of more and more money to keep doing it? Or was it that, having put so much time, energy and money into pursuing Mr Fletcher, that Thierry Darnaudet and Samleang Seila knew that they would have a lot of egg on their faces if he were to receive a fair trial and be found innocent.
ReplyDeleteMind you, there are others who also had a vested interest in Mr Fletcher being found guilty - SISHA, CEOP two British embassies and others who had acted as prosecutors, judge and jury in the months leading up to his illegal arrest in Thailand.
A conspiracy of silence continues to this day as none of these people, none of these organisations, want the truth to emerge in an open court. Better that an innocent man die in jail than that they have egg on their faces.
One of those who has acted as prosecutor, judge and jury heads up a highly respected human rights organisation - Naly Pilorge of LICADHO. Naly has refused to divulge what evidence she claims to be in possession of regarding Mr Fletcher's rape of Yang Dany and will not, as a matter of principle, advocate on behalf of his right to a fair trial.

You still think the NGO's have that much power that they can make a decision for the courts and direct a judge to put a person in jail - you are kidding yourself. Fletcher's case was reviewed by a prosecutor, an investigating judge and a sentencing judge and all 3 found him guilty. Then a judge at the appeals court found him guilty. Thats a lot of judges for the NGO's to bribe wouldn't you say! Rickets the fool!

DeleteI appreciate that you are totally uninterested in facts, but it is a fact that Mr Fletcher has never been able to present any defence to any court this past 5 years. He has not even been able to address a court and make a statement. This is contrary to Cambodian law.
Both of you are missing my point. Do you really think that the NGO's collect evidence and present that directly to the courts. No they dont, there is judicial process. NGO's if they have an MOU, collect information and must present that to the police who then must re-investigate the information provided. If the police deem that a crime has been committed then they must get permission from their boss, normally a 2 star general and the information is then presented to the prosecutor. The prosecutor then starts his own investigation and collects his own evidence or directs police to collect more evidence. if he/she feels that there is sufficient evidence then he/she presents that to the investigating judge who then does their own investigation and then presents that to the trial judge. This has all occurred in the case of Fletcher. the NGO's weren't there persuading the judiciary to make their decision in each process.

DeleteI am unsure if you are really naive or if it suits your purposes to act naive. What you describe is not the way the courts work. it is the way they work in theory. You know that. Everyone knows that.
None of what you describe as due process has occurred in Mr Fletcher's case. None. NONE. He has never been interviewed by a policemen this past five years, let alone by an investigating judge.
here is a small quote from a letter Mr Fletcher sent to the Minister of Justice last week:
Article 44. Opening of Judicial Investigation
“In the case of a felony, the Prosecutor shall open a judicial investigation. The judicial investigation shall be based upon the initial submission provided to the investigating judge. The initial submission (to be prepared by the Prosecutor) includes: A summary of the facts….
The initial submission shall be dated and signed.
These formalities shall be strictly complied with or the initial submission shall be void.”
I have never been interviewed by an investigating judge. I was never presented with a signed and dated summary of the facts before my trial. I did not know about my trial until it was completed.
On the basis of Article 44 alone the original trial should be declared illegal

Should they stay ask for their names to be written down in khmer and english and their phone number. If the encounter takes place in the hotel lobby ask the staff to HELP out. Having all this (even a photo will do) should be enough to discourage further attempts to stalk, intimidate or try to get you paranoid again.
The anonymous blogger that claimed to have heard that you'll be arrested in 3 days is probably one of the people that actively helped to prevent David Fletcher having a fair trial. Perhaps he / she even tried to bribe the court/procecutor to get active on you. What they don't realize is the fact that your arrest will create a shitstorm on facebook and other internet media. Since the intl. press except Cambodia daily is firmly in bed with the intimidators don't expect anything from them.
I find it hilarious that people that try to get you nailed by the questionable justice are posting such nonsense ANONYMOUS. Perhaps they, too have too much dirt to hide and therefore don't reveal their real identity to be challenged.

Given the fate that so often befalls people whom the rich and powerful want to get rid of I have, needless to say, given some thought to who these mysterious two men were:
(1) Two men sent by APLE to intimidate me by their very presence and mention of the name Samleang Seila.
(2) Two actual, but ununiformed policemen, doing Samleang Seila’s dirty work for him.
(3) Two real policemen, not in uniform, doing the work of the Phnom Penh Municipal Court but reticent to hand over whatever document they had. (Why did they mention Samleang Seila?)
(4) Two men with nothing at all to do with APLE or the Phnom Penh Municipal Court engaged in a scam of some kind.
I have no idea which of these is the case. Perhaps there is another alternative I have not thought of!
That the two men actually appeared can be verified by hotel staff.
My suspicion is that (2) is the case – two real policemen freelancing for APLE.
If you are reading this, Seila (and I know you are) please let us know what role (if any) APLE played in the appearance of the two men in my foyer last night?

DeleteThere are many types of Police in Cambodia. One of my khmer neighbors recently "bought" himself the title (and the uniform) of a policeman. He is not really working for or at the police but everyone thinks he really is a policeman. With the "bought" title he gets some benefits like not being challenged in case of a problem etc.

Your question of Anonymous 8.41, asking if s/he had "some factual material" is interesting given your own total lack of interest in "factual material" when it comes to the charges laid against Mr Fletcher. There is no "factual material" that suggests he raped Yang Dany.
The facts that matter with regards to Fletcher is that he has been found guilty of sex offences 2 times. 1st in the UK and 2nd in Cambodia. You can rant on all you like with your conspiracy theories but facts he was convicted by legal courts and he is jail.

If he were to be charged with drug-related offences in 2015 his previous conviction would be of no legal relevance. (2) The court case in which he was found guilty in 2011 was not 'legal'. It was illegal in accordance with Cambodian law. I know you have retention problems like water on the brain, thus I will give you a brief history lesson;
Two and a half years ago I wrote to his Royal Majesty the King of Cambodia, and I am not joking or being disrespectful, informing his Majesty that I would never accept an amnesty, royal pardon or pardon. I explained that whilst most respectfully, that pardons do not declare innocence, this is why I would decline. I am sure James will concur we had this conversation when we first met.
You see birdbrains, I am not interested in freedom, I only want a correct trial according to Cambodian Law, International Law and Human Rights, which has been denied me. I am aware I am talking to a Martians understanding of the law and true justice, being on the same level as APLE, CCF, SISHA, LICAHDO, ADHOC,CEOP and the FCO.

DeleteYes, Mr Fletcher's life experience does include having illegal sex with a young woman just shy of 16 years old. The word used to describe this crime is ;statutory rape'. This is the same crime of which James Mc Call, who heads up Scott Neeson's Child Protection Unit is guilty of if he began his sexual relationship with his wife-to-be when she was 15.
If you insist on calling Mr Fletcher a rapist, be consistent and call James Mc Cabe a rapist also.

fletcher was convicted by several cambodian courts, James Mc never was, so there is the major difference. (1) David Fletcher was found guilty at an illegal trial. You know this. He was not present. He was not legally represented. He has, in effect, had no trial.
(2) James Mc Cabe was found to be guilty at a trial in which he was legally represented, in which evidence from both sides was heard. Big difference.
(3) I have all the court documents and it is not true that numerous underage victims came forward to testify about indecent acts. This is what you were implying in your statement to Andrew Drummond but you have never backed it up with any evidence. You wanted to get rid of Mr Fletcher for your own personal reasons and your reference to his 'grooming' young girls fitted in perfectly with the plans of others who were determined to get Mr Fletcher one way or another.
(3) No, I ws not at the original trial. Or nor were you.
(4) As for my "purchasing the virginity rights of several girls" if you have any evidence of that you should provide it to the police immediately.

If you wish to go down the grubby path that you now seem so keen to embark on, (your Neeson Trolls having failed in their attempt to shoot the messenger) will this lend you credibility? Or will your own ham-fisted attempt to label me a pedophile only serve to more deeply entrench your reputation as a man who plays fast and loose with the truth in order to keep the donor and sponsor dollars flowing in and to quell any criticism.
If there is someone scrutinizing my activities in Cambodia, as I have (and continue) to scrutinize yours, this is as it should be. I should be held as accountable for my actions as you should be. And if anyone finds a discrepancy between what I write and how I act, if they find that I Iie on a regular basis, they should expose me as a fraud. This is as it should be. It should apply to you, to me, to all NGOs, to the Cambodian government. This is the role (or one of the roles) of the 4th estate – of which bloggers are a recent addition.
I will, incidentally, keep asking you questions until you answer them. The most pressing question, just now, is whether you have any evidence that Mr Fletcher was ‘grooming’ young girls back in 2010 when you said as much to Andrew Drummond. Next in line would be those questions I have asked you about the ‘gifting’ of homes to poor Cambodian families. I have described this as a scam. You could prove me wrong by explaining just how homes ‘gifted’ to Cambodian families have wound up being owned by whoever owns the land on which the houses have been erected. You could so easily prove me wrong about all sorts of things if you have the facts (demonstrable facts) at your disposal. Your Trolls say you are too busy or have no interest in responding to the questions I ask on this blog. it is of no real consequence how many people read this. I am surprised at how many do. I ask you to do this in good faith. By doing so for the very first time I will be interviewed by police, have an open trial where I can defend myself, in open court with the public and unbiased international media present.
If you would do this I would be grateful, it will clear issues between us in an open manner. The FCO are now working with me, they have apologized for past errors, I have this in writing if you would like to see it on your visit.

APLE still parades people proven innocent on it's online perpwalk website that have been aquitted by the court and proven innocent.
for example : (Rudolf Knuchel, see separate section) Instead of compensating these people APLE keeps it's vicious behaviour up and continues spreading it's lies in order to avoid compensation to the victims.
There is nothing worse than to be labeled as a "potential pedophile" simply because you are a white male and therefore are considered a legitimate target for NGO's like APLE. But then who wants to complain if even the French President Sarkozy uses this tool to keep uncomfortable Questions from Journalists at bay?
The French President had no problem getting the French Human Traffickers of "L'arche de Zoe" (Zoe's Ark), headed by Philippe van Winkerberg from Castellane in France, out of jail in Tschad where they were incarcarated for kidnapping over 103 Children from their home in Tschad and claiming that they where orphans from Darfur. They had already collected up to 6.000 Euro for each kid (all between 1 to 10 years old) from 250 french People that wanted to adopt them in order to get them out of their misery. These "NGO's" had a charter airplane waiting in order to fly these kids to France and where stopped at the last minute by the Tschad authorities. The Tschad Court sentenced them to 20 years in Jail with hard labour, which they deserved. A few weeks later the French President picked them up personally with his wife to fly them home and release them without any legal consequences. It's unclear how much that action has cost the french tax payers. It also shows how the french government is handling child abuse and human traffickers. In that enviroment People like APLE founder and president Thierry Darnaudet have absolutely nothing to fear. For the French this is just another business !
It really does their anti-APLE agenda no good when they pick examples like Rudolf who's been busted at least 3 times for diddling kids in Cambodia, is a classic example of someone who uses the corruption of the sysyem to escape the charges, and who everybody that's been here more than a few years knows is a kiddie-fiddler. Is there no barang in Cambodian jail who is clearly not guilty or about whom there is at least significant reasonable doubt about their guilt?

ReplyDeleteIf you are in Cambodia you will most certainly end up in a Database on Pedophiles, run by APLE who at some time will take your picture without your permission ! You don't even have to be with or near a Child, it can happen anywhere. These Pictures end up in a central Database, APLE operates outside the legal system. You therefore are likely to end up next to known Perverts (Pedophiles) without any reason other to be a potential target for profit because you are white and male.
Furthermore many have beeing falsely accused and only released after paying off corrupt officials; afraid to speak and humiliated beyond words. APLE is using "Questionable and Unorthodox Methods like Gangstalking" as one of the moderators in APLE's Documentary Movies puts it. Nevertheless western media like trash TV specialist RTL,but also BBC,NTV,TV5,WAT TV are not hesitating to use this material for prime time view.

Tourists are already treated like Criminals when entering Cambodia. Your Picture is taken, prints of all 10 fingers are scannedfingerprints-cambodia.jpg and used for god knows what, at Immigration. The profiling madness has just reached new hights.
Will every westerner have it's DNA taken entering Cambodia,soon ? All these steps have been forced on the Cambodian Government through western powers, mainly the US, but NGO's are a big active part of it. Where will this madness lead to ?
The Child Protection NGO's in Cambodia have clearly gone too far, but seem to be unstoppable on their destructive rampage !!
It's time for the Cambodian Government to put an end to this follie which tarnishes the image of Cambodia in the worst possible way. Is the TSO (travelling sex offender) the new Terrorist ? It's also time for the western Media to stop it's "cut and paste" journalism and present a more balanced reporting and current Information on the realities on the ground. And, since we are at it, what is a Sex Offender ? Do members of the Camboidan Military, Police and Government aswell as foreign Embassies like the US Embassy in Phnom Penh and Bangkok qualify, or are they "exempt" from scrutiny and proscecution ?
Furthermore it's about time the Media does some "investigative Journalism" on Thierry Darnaudet, his Home for Street Children in Calcutta, India (C.R.D.S/ACTT) and in his hometown St.Paul les Dax in Southwestern France.

Foreign pedophilia represents only a small percentage of overall child sex offenses in Cambodia. According to Ministry of Interior 2005 statistics there were 665 reported cases of child sex offences, resulting in 280 investigations with 397 offenders arrested. Only a little more than 1 percent of these child sex offenders were foreign nationals !!
This has lowered much in the years up to 2011.
Yet, when watching western Media reports on Cambodia one has the false impression that Child Abuse by western Men is rampant. And this is due to the "cut and paste" Journalism of our times where the western press is publishing everything NGO's throw at them in their Press Releases.

Why doesn't he live in Cambodia and endure the scrutiny himself ? There are many more questions about him, still unanswered. It's also time to ask authorities in Calcutta, India why his ACTT Home for Street Children appears in none of the NGO Listings there. Has it ever been registered ? Did any Child Protection NGO ever check on him ??

Firstly it is only normally 4 fingers on the right hand and secondly if you have traveled much (which you appear not to have done from your limited knowledge) then you will know that the taking of photos by immigration is quite normal in many countries. I have entered Cambodia 30-40 times and never had more than 4 fingerprints taken and have certainly never been made to feel like a criminal, in fact I always find the immigration officers to be very courteous. I don't know but maybe it is because I might have a far less lets say "interesting" past than you for immigration to take special interest in you.
