Imagine this:
A man is accused of murder. Let’s
call him Mr Scott. And lets call the accuser Mr Apple.
The victim’s body has not been found
(let’s call her Ms Licadho) but masses of circumstantial evidence and lots of
chatter on popular online blogs suggests that Mr Scott killed Ms Licadho.
Mr Scott is not invited to attend his
murder trial. It is held in secret. He reads in a newspaper a few days later
that he has been found guilty and is sent to jail for 10 years.
Mr Scott is told by Cambodian
authorities he can request a re-trial but that he must get his paperwork to the
court in 10 days.
Through no fault of his own Mr
Scott’s paperwork arrives late at the court.
There is a subsequent court hearing
to determine whether or not Mr Scott is entitled to a re-trial.
Mr Apple’s lawyer is in court, loudly
demanding that Mr Scott not be allowed to appeal his sentence because he got
his paperwork to the court late.
The judges tell Mr Scott he has
missed the deadline and that the option of presenting evidence of his innocence
to the court no longer exists. He must serve his full 10 year jail sentence.
Then Ms Pilorge reappears. She has
not been murdered at all. She has taken
part in an elaborate life insurance scam.
The Appeal Court judges refuse to
acknowledge the existence of this new evidence that Mr Scott is not guilty of
murder. He got his paperwork into the court late. End of story.
Mr Scott must spend the rest of his
life in jail for the murder of Ms Pilorge, though she is demonstrably still
alive.

Fletcher delivered late to the court. Note the highlighted names of those to be
called as witnessed. Bear in mind also the famous line from “All The President’s

police officer named on my warrant and alleged crimes.
The global right to stand and make my
own defense statement to the Judge in the Royal Court.
The right to call named expatriates and NGOs NGO perpetrators.
The right to have my retrial
monitored by Fair Trials International, human rights and Amnesty International.
I refuse to be involved with corruption
payments as my accusers, in any way, shape or form.
I request my retrial be according to
international law and human rights, signed and agreed obligations by Cambodia.
I request the following to attend the
trial; APLE NGO, Scott Neeson CEO of CCF,
expatriate owner of wwwkhmer 440.com, owner of the Fancy
Guest House 15th St., company accounts manager of Angkor beer, Yang
Dany, police officer in charge of residential records for expatriates.
I request the Court of Royal Cambodia
for uninterrupted justice based on evidence and not hearsay.
Dr Kek Galabru, will you be commenting on the case of Mr Fletcher? I do not care in particular about Mr Fletcher but it is a matter of concern to me that Licadho is very selective in which human rights it supports and which it does not. It is also a matter of concern to me that Naly Pilorge appears to be closely associated with Action Pour les Enfants and may have been one of the founders of this NGO. Is this so? If so, are you, as President of Licadho, satisfied that Action Pour les Enfants carries out its investigations with due respect for Cambodian law and for the human rights of those accused of criminal offenses?
ReplyDeleteYes, LICADHO is selective in its choice of which human rights abuses it will not speak out about. The most important of these is the wholesale removal of children from their families by NGOs who either trick impoverished parents into giving up their children (with fraudulent 'contracts') or who make promises to these parents they have no intention of keeping. Such 'orphanage' and 'rescue' scams have been going on for years, causing both children removed and their families enormous distress.

But the worst in this all is the NON-Performance of Licado - a NGO that calls itself a Human Rights Organisation (NOT).
David Fletcher became a commodity and whoever played part in the case had financial benefits waiting for them.
The positive side of all this is the fact that we all know now what world we're living in. If it's in the (financial) interest to get you off the screen these people can make anybody disappear. Not without trace, as long as you end up in jail, which will just prolong your suffering.
Other methods are known, like the one used to let real paedophile Alexander Watrin disappear forever with a deadly traffic accident in Sihanoukville. Watrin never contested the accusations but was permitted to stay in Cambodia after being pardoned by the Cambodian King. He didn't last long.
Yes, David Fletcher and others in his position are but pawns in a large chess game. In order to justify their existence NGOs such as APLE and the Cambodian Children's Fund 'Child Protection Unit' need to maintain high arrest and conviction rates.
DeleteI have no doubt that many of those who get caught up in the nets of such organisations are guilty. However, there are also plenty who are convicted on the basis of evidence that would not stand up in a court in a country in which the rule of law prevails.
In the absence of a competent judiciary, such men (and Fletcher is but one) can be used to feed the funding machine - sex offenders in one end, money out the other end.

Yes, I have spoken with the man who failed to deliver the documents. He is a decent and caring man and he fucked up. Mr Fletcher bears no grudge against the man. They are still friends. He will not, however, admit in public that he forget to deliver the documents in time.

I had really hoped that someone in the more prestigious position of the Minister of Justice would have too much integrity to be bribed. I now believe that there is no official or person of the highest power in Cambodia who cannot be bought if the price is right. Cambodia will remain a poor third world country as long as this corruption and lawlessness continues. The Khmer families get poorer and poorer while the corrupt government officials and NGOs get richer. It is so sad that nobody in power has the integrity and guts to fight the corruption. Apparently they have no pride and do not care that their country is notorious worldwide for corruption.

ReplyDeleteA British man convicted of raping a teenager in Phnom Penh in 2009 had his case thrown out of the Court of Appeal on Friday, then accused a prominent NGO head of conspiring to frame him.
Judge Pol Sam Oeun made short work of the hearing, declaring that as David Fletcher, 71, had already had one appeal rejected, the court would not process his latest appeal—a complaint against the procedure of the Phnom Penh Municipal Court, which in 2011 sentenced him in absentia to 10 years in prison.
“In accordance with the law, he only has the right to choose one path,” the judge said. “The appeal process is not correct.”
“The Court of Appeal does does not accept the appeal.”
Outside the courthouse, Mr. Fletcher—who has been convicted of twice raping Yang Dany, a 17-year-old girl he knew through his unregistered NGO, The Rubbish Dump Project, which once provided assistance to families living at the Phnom Penh dump—said that he had been set up.
Mr. Fletcher claimed that Scott Neeson, head of the Cambodian Children’s Fund (CCF), which also works with children at the dump, had felt threatened by his presence, and conspired to have the rape charges fabricated.
“Neeson saw me as a threat. We had an argument maybe two years before [the rape allegations arose] on the dump, and I told him he was a waster,” he said.
Mr. Fletcher was arrested in Thailand on June 27, 2010, two weeks before Ms. Dany’s mother filed the rape complaint with Cambodian police, and one week after media reports claimed that Mr. Fletcher was using his charity to access children.
British newspaper The Mirror quoted Mr. Neeson as saying: “There is little doubt Fletcher devotes his time here to befriending young girls.
“He tells their parents he wants to adopt them, care for them. They think because he gives out food he is good. But he is grooming them.”
Mr. Neeson could not be reached for comment on Friday. CCF country director Sok Channoeurn said she did not know enough about the case to comment.
In October last year, Ms. Dany and her mother, Keang Sokun, recanted the rape allegations in an interview, saying that child protection NGO Action Pour Les Enfants (APLE) had told them they would receive $5,000 in compensation if they made the claims.
“APLE knew that Dany was not raped,” Ms. Sokun said at the time, adding that while Mr. Fletcher had removed her daughter’s clothes, the encounter went no further.
As the legal representative of Ms. Dany, APLE has lobbied against any retrial, despite acknowledging that a medical examination showed that the teenager’s hymen remained intact after she was raped.

We now have it in writing that human rights for a fair trial means nothing to both of the above mentioned NGOs. It's evident that all of those who remain mute (5000 NGO including Neeson's CCF) are complicit in a defacto death sentence which I suspect APLE had long planned already.
So now we have a different picture of those that preach Human Rights, Outreach, Shelter, Protection and mean destruction, endless suffering and even death. This is unscrupulous NGO Business live.
Perhaps David Fletcher has become such a hot potato for those mentioned here that they would rather stick their head in the sand and hope he gets a heart attack, soon.

ReplyDeleteThis is a battle I did not go looking for but, once I had become involved in it, is one I was determined to see it through to the end – bitt or happy. I still am. There is more than one end and, in this matter, I wear more than one hat.
I will start with my filmmaker investigative reporter hat:
I have hundreds of pages of documents and know more about this case than anyone – most especially the courts! These are not merely court documents (of which I have the full set) or of FOI documents (of which I have most, but not all) but other documents acquired by hook and by crook, with the aid of someone more literate in the world of internet ‘exploration’ than I am.
As a filmmaker and book-writer I have more than enough information to be able, eventually (preferably in a court of law) map out precisely what has happened in this case. The cast of villains is a long one but some are amateurs, some played only bit roles and others pulled the strings to create the mixture of cockup and conspiracy that resulted in Mr Fletcher being denied a fair trial. These people will be exposed, regardless of what happens in the Supreme Court; regardless of whether or not Mr Fletcher is alive. I will be relying on facts only; facts that I can back up with documents. What I produce, both in written and filmic form, will be vetted by two lawyers to make sure that there is nothing defamatory in what I produce.
I have only revealed about 70% of what I know and can prove on this blog. The rest must await the Supreme Court. Or, if the Supreme Court turns out to be a repeat performance of what took place in the Appeal Court, the final 30% will be included in my book and film. Neeson’s police ‘minders’ (San, for instance) may well be able to protect him in Cambodia but their influence does not extend beyond Cambodian borders.
The other hat I wear here is that of a human being who has got to know Mr Fletcher quite well this past year.
To be found guilty in a secret trial in which no evidence was presented to the court in support of the rape charge other than a statement from Yang Dany, which she now claims not to be true, is amongst the worst experiences any man can have.
Not only has Mr Fletcher been robbed of more than five years of his life, his reputation had been destroyed, along with his relationship with his family and community back in the UK.
Whilst the cast of villains in this Cambodian legal farce is a long one, none of this would have been possible if Scott Neeson had not got the ball rolling – not just with his defamatory statement that Mr Fletcher was ‘grooming’ young girls but in his working with the British Police (CEOP) to see Fletcher ‘sent packing’.
Neeson revealed himself, in his actions, to be a man of no principles in the role he played at the outset, in June 2010. Yes, he experienced the short-term satisfaction of getting rid of a man he considered to be a ‘competitor’ in the dump; a man whose work with children Neeson felt threatened by. Little did Neeson realize, at the time that he made this defamatory statement, that he had sown the seeds of his own destruction and that of his ‘baby’, the Cambodian Children’s Fund. The reputational damage done to CCF will, when the truth is known, be far greater than was meted out to Somaly Mam.
I have given both Scott Neeson and the CCF board ample opportunity this past year to recant the accusation of ‘grooming’, but they have declined the offer.
So be it.
I have drifted from my topic somewhat, which is the enormous emotional pain experienced by David Fletcher caused by this five years in jail for a crime that it was impossible for him to have committed. This would be revealed in any fair trial. In the absence of a fair trial it will be revealed in two media: book and film.
I can only hope that the facts are first revealed to an honest Supreme Court and that David Fletcher walks as a free man. How an innocent man could get stitched up like this is beyond belief. How the Cambodian courts could turn such blind eye is beyond belief! How most of the media could turn a blind eye is beyond belief! How so many NGOs could turn a blind eye is beyond belief! How the FCO could treat one of it's own citizens in this manner is beyond belief! Who can feel safe in country where there is no justice? SCAMBODIA it is!!!

DeleteNot for the first time have you made statements along these lines. They are either designed to intimidate or an announcement that you (Team Neeson) has set in motion the sequence of events that will result in my being called to the court.
If a summons is drawn up for me to appear in court, there are two possible ways that this could play itself out:
(1) The summons is noter delivered to me, I am not appraised of the date of the court case, the trial proceeds without me and I find out the result some time later.
(2) The summons is delivered to me and it outlines precisely what offence I have been accused of and by whom.
There is nothing I can do if option (1) is the chosen route. If option (2) transpires I will, in the interests of transparency, publish the contents of the summons here and will, as is my legal right under Cambodian law, defend myself in court.

This blog is primarily a record of my attempts, this last year, tosecure for Mr Fletcher, a fair trial.
Along the way, as much by accident as through thorough research, I found out a good deal about the Cambodian Children's Fund and have published it.
Why?
Because Scott Neeson played a major role in setting in motion the sequence of events that led to Mr Fletcher's arrest in Thailand but telling Andrew Drummond (and hence thens of thousands of others) that Mr Fletcher was 'grooming' young girls.
Scott Neeson'[s defamatory comment about Mr Fletcher was not the only reason I was curious to know more about CCF. A few years ago I had had a run in with Neeson over his refusal to return two girls to their parents when asked to do so. I have written about this at length but for those who may have only just started to read this blog, Neeson claimed that he was under no obligation to return the girls to their family because the mum and dad had signed a 'contract' giving CCF custody of the girls. When asked to produce the 'contact' Neeson refused.
I then discovered that NONE of the parents of children in CCF residential care are allowed to keep copies of the 'contracts' they enter into with CCF.
And ten there is the World Housing scam - houses 'gifted' to poor families in Steung Meanchey winding up in the hands of CCF, then to be rented to the families.
Law on Suppression of Human Trafficking and Sexual Exploitation is clear:
Article 8:Definition of Unlawful Removal
The act of unlawful removal removal in this act shall mean to:
1) Remove a person from his/her current place of residence to a place under the actor’s or a third persons control by means of force, threat, deception, abuse of power, or enticement, or
2) Without legal authority or any other legal justification to do so to take a minor person under general custody or curatoship or legal custody away from the legal custody of the parents, care taker or guardian.
Article 9: Unlawful removal, inter alia, of Minor
A person who unlawfully removes a minor or a person under general custody or curatorship or legal custody shall be punished with imprisonment for 2 to 5 years.
