# 196 letter to Minister of Justice re Mr David Fletcher

Dear Mr Ang Vong Vathana

re David John Fletcher

Mr Fletcher has been in jail for six years now without a trial.

In the past six years Mr Fletcher has not been interviewed by the police or by an Investigating Judge.

For six years MrFletcher has been denied his legal rights in accordance with the Cambodian Code of Criminal Procedure.

Is such contempt for due process, for the legal and human rights of Cambodians and non-Cambodians, an impression of Cambodia you wish to impart to the rest of the world, Minister?

In mid-May 2016 the Supreme Court wrote to Action Pour les Enfants (APLE) requesting a response to Mr Fletcher’s appeal to the Supreme Court.

It is my understanding that APLE had, in accordance with Cambodian law, 30 days to respond to this request made by the Supreme Court. It is also my understanding that APLE has failed to adhere to the Supreme Court’s request.  APLE’s contempt for, manipulation of, the Cambodian legal system is well known and well documented.

As will be apparent to anyone who is familiar with this case, the key witness, the alleged rape victim, Yang Dany, was sent to China so that she could neither testify in any trial or speak with journalists. It is possible that she was trafficked to China by those (and there are many) who have a vested interest in Mr Fletcher not receiving the fair trial that is his right, in accordance with Cambodian law.

Yang Dany has disappeared in China. She cannot now be found. Unless APLE can secure her return to Cambodia, Yang Dany will not be able to testify in any court case that may arise as a result of Mr Fletcher’s submission to the Supreme Court. How a trial can take place in the absence of the key witness is a mystery but, alas, an all-too-common occurrence in Cambodia.

As will be apparent to anyone who is familiar with this case APLE has made it clear that it does not believe Mr Fletcher raped Yang Dany. Mr Samleang Seila has gone on record as saying that Mr Fletcher must serve his 10 year jail sentence, not because he is guilty of rape but because he failed to deliver paper work to the Phnom Penh Municipal Court on time. This is Mr Samleang Seila’s concept of justice!

As will be apparent to anyone who is familiar with this case Yang Dany, the alleged rape victim, has denied on several occasions that she was raped by Mr Fletcher – in the presence of one filmmaker (myself) and two other journalists.. Her assertion that she was not raped is backed up by medical evidence. After she was allegedly raped twice by Mr Fletcher (brutally, according to court documents), Yang Dany was examined by a doctor under a court order. The doctor declared that her hymen was intact; that she was a virgin. Not only had she not been raped; she had never had sexual intercourse. The presiding judge’s declaration that Yang Dany’s hymen must have grown back is nonsense. Unfortunately, it is nonsense of a kind that all too often flows from the lips of ignorant and ill-informed  judges in Cambodia.

As will be apparent to anyone who is familiar with this case, in addition to this persuasive evidence that Mr Fletcher did not rape Yang Dany, there is the fact that he was not in Cambodia at the time of the alleged rapes. Evidence of this would have been found in Mr Fletcher’s passport had the British Foreign and Commonwealth Office not willfully destroyed the passport, knowing that it contained evidence of Mr Fletcher’s innocence.

After six years in jail, Mr Fletcher has yet to be interviewed by the police or an investigating judge. After six years in jail he has yet to have the opportunity to present evidence to any court in support of the proposition that he is innocent of the charge of rape. This is justice Cambodian style. And you are presiding over such a system – either unwilling or unable to grant men and women charged with a crime even the most basic of the legal rights the Cambodian Constitution has accorded them.

Action Pour les Enfants does not want Mr Fletcher to receive a fair trial. In such a trial the NGO would be revealed to be incompetent, corrupt or both. The British Foreign & Commonwealth Office, likewise, does not want Mr Fletcher to receive a fair trial. In such a trial the British Embassies in both Cambodia and Thailand would be revealed to be incompetent, corrupt or both. Not even the human rights organization LICADHO would welcome a fair trial. Naly Pilorge has decided, on the basis of scuttlebutt, that Mr Fletcher must be guilty. Perhaps this is unsurprising given that Ms Pilorge was one of the founders of APLE – an NGO whose money-raising modus operandi necessitates a constant stream of sex-offender convictions. Without convictions APLE loses its raison d’etre. If there are not enough real pedophiles  to convict, men such as Mr Fletcher must be found and accused of crimes for which there is no credible evidence.

Everyone knows that this is the way justice works in Cambodia, Minister. It is time for this corrupt system to be brought to an end.

Before Mr Fletcher was arrested in June 2010 he was subjected to a trial by the media. The owner of a social networking site by the name of Khmer440, Peter Hogan, decided to use his site to defame Mr Fletcher. On the basis of no evidence at all, Mr Hogan accused Mr Fletcher of being a pedophile. One of many to believe what was published about Mr Fletcher on the Khmer440 site was Scott Neeson – a man who, as head of the Cambodian Children’s Fund, felt himself to be in competition with Mr Fletcher, who was also helping poor families in the Phnom Penh rubbish dump at the time. Mr Neeson went public with the following comment – made to a now disgraced sensationalist journalist, Andrew Drummond:

“There is little doubt Fletcher devotes his time here to grooming young girls…They think, because he gives out food, he is good.  But he is grooming….The fact is that these children can be bought. It's difficult to stop it. The British Embassy have been told about Fletcher. Many organizations have files on him, but nothing has happened. If you can get this guy sent packing you are doing a service to the children here.”

A week later Mr Neeson’s wish came true. The British Embassy in Thailand was complicit in having Thai authorities arrest Mr Fletcher. He was not charged with any crime but held in jail, in Bangkok, for a few weeks until Cambodian authorities could manufacture, under instructions,  some crime to charge him with. It took 3 weeks for Yang Dany to be convinced that there was a $30,000 pot of gold waiting for her and her mother, Sekun, if she charged Mr Fletcher with rape – the same man whom, a few weeks early, she had referred to as her ‘fiance’ and a ‘good man’. Yang Dany and her mother, Sekun, were manipulated in a way that ‘witnesses’ all too often are in this country. Extreme poverty, combined with intimidation and the promise of great wealth, can induce many Cambodians to allege whatever is asked of them by those for whom such allegations are to their advantage.

In any properly constituted court of law Mr Fletcher’s case would have been thrown out of court  in July 2010. Instead, Mr Fetcher has been denied even the semblance of a fair trial. He is in jail now as a result of lies told by Peter Hogan and Scott Neeson. He is in jail now  because the British Foreign & Commonwealth Office destroyed evidence of Mr Fletcher’s innocence – his passport. He is in jail now because Mr Samleang Seila, a man of questionable moral scruples, believes that a 10 year jail sentence is appropriate for a man who fails to deliver his paperwork to court in time.

Now Mr Fletcher is very ill. I have visited him many times this past two years but was shocked, last week, having not seen him for six weeks, to see that he has lost a lot of weight and can barely walk anymore. He has no energy and sleeps most of the time. I wonder if he is dying? 

Mr Fletcher has requested of the British Embassy in Phnom Penh that he be allowed to see a qualified physician to see what illness he is suffering from. The British Embassy has refused to assist Mr Fletcher, as it has refused to provide him any assistance this past 6 years. Mr Fletcher is an embarrassment to the British Embassy – a constant reminder of its own incompetence and its corrupt destruction of his passport. For Mr Fletcher to die in jail, having never received a trial, would suit the Foreign & Commonwealth Office well. It would never ever have to be held accountable for its destruction of Mr Fletcher’s passport.

Mr Fletcher does not wish to subject himself to the prison system’s version of medical treatment again. The last time he was seriously ill Mr Fletcher was tied into a bed and, unable to move, soiled himself. He was then taken out into the courtyard of the hospital, naked, and hosed down like an animal in full view of the public. A photograph of this shameful spectacle was taken. I have enclosed it.


Minister, I request the following:

(1) Allow Mr Fletcher to see a qualified physician to determine what sickness he is suffering from. (I will pay the doctor’s fee)

(2) Insist that APLE respond to the request made of the NGO by the Supreme Court in accordance with Cambodian law.

(3) Recommend to the Supreme Court that a hearing be held as soon as possible so that Mr Fletcher has an opportunity, after six years of waiting, to present a case in his own defense.

    1. Yes, man's inhumanity to man. Of course Mr Fletcher is in good company when it comes to prisoners who have been convicted in Cambodia without due process. I have met others in my visit to the prison. And, of course, there are all the political prisoners in jail on trumped up charges for having had the temerity to NOT be CPP or to be critical of the CPP.

      There are no testicles in this shot. There could have been. I cropped them out. These shots are humiliating enough as it is. And they are intended to be. How would you feel, how would any reader here feel, if they had been led outside, into a courtyard, and hosed down in full view of staff and visitors alike?

      You will probably get your wish. Mr Fletcher will probably die in jail. Without ever having had his day in court.And you celebrate this anonymously. You are a coward and a person without conscience and without a sense of justice.

      If my letter to the Minister seals Mr Fletcher's fate, so be it. I have published it with Mr Fletcher's permission. He is dying. He has nothing to lose. The Cambodian justice system is corrupt. We all know that and there is no point in pussy-footing around it. The Minister knows it and to pretend otherwise is to insult his intelligence also. If he wants this corrupt system to be his heritage, so be it.

      As for my own 'agenda', as you call it, at lest I have had the balls to stand up to a system you know to be corrupt. You have not got the balls to do anything other than make your comments anonymously.

Speaking of hell, if Mr. Fletcher should go there, he would have a lot of company---Neeson and his cohorts, Cambodian media and law enforcement, British Embassy and government officials and everybody who is responsible for either having him imprisoned or doing nothing to free an innocent man.

      It is questionable that Neeson has done anything good with his so-called charity, but no amount of good deeds will save him from hell if he continues to do nothing to right the wrong he has done to Mr. Fletcher.

What a callous and unfeeling individual you are.

      You are clearly also someone who has little time or respect for the notional that a person is innocent until proven guilty. What Mr Fletcher deserves, what any and every person accused of a crime deserves (including Khmer Rouge participants in genocide) is a fair trial. You would deny Mr Fletcher this right just because you feel, deep in your bones, that he must be guilty.

      You suggest that you know more of the truth than I do and yet you do not have the balls to come out in public and state what this truth is. Your idea of justice "(let him rot in jail") makes you well suited to be living and working in Cambodia and not in Australia - where basic human and legal rights are accorded to men and women accused of crimes as heinous as rape.

      Given that you neither live nor work in Cambodia, a few questions for you:

      (1) Have you ever met Mr Fletcher?
      (2) On what basis do you refer to Mr Fletcher's 'victims? Have you met and spoken with any young woman who claims to have been sexually abused by Mr Fletcher?
      (3) Do you believe that Mr Fletcher has been tried by a Cambodian court? Given that he has (a) never been interviewed by the police, (b)never been interviewed by an Investigating Judge, (c) has never been able to present a case in any court in his own defence, (d) the alleged victim insists that she was not raped, (e) the doctor who examined the alleged victim declared her to be a virgin, (f) Mr Fletcher was not in Cambodia at the time of the alleged rape!?

      Despite these facts you are sure he is guilty, right? On wha basis? Did Scott Neeson tell you? Naly Pilorge?

    1. Neeson wanted and needed to get rid of Mr Fletcher. In his paranoia, for which he is well known, Neeson saw Mr Fletcher as competition in the dump. He wasn't. Fletcher was not trying to start a kingdom and make a business out of his small operation. It was just that - a small operation. It was not an NGO. It was not a charity - just one person, often with others in tow, giving food to men, women and children working in the dump and, at times, providing medical care to those in need of it. Neeson, who is ruthless in his pursuit of money, power and respectability (secular sainthood) felt threatened by Mr Fletcher and chose a coward's way of getting rid of him - telling the British Embassy that Mr Fletcher was grooming young girls; telling Andrew Drummond that he was grooming young girls. And all the while, and for years hence, Neeson plasters his Facebook pages with photos of himself with little girls in his arms! Really!

      Neeson's paranoia led to him employing four bodyguards (to protect him from whom!?) but CCF's money problems have forced him to cut it back to 3 bodyguards. Hopefully these will be sufficient to protect him from the angry CCF kids who have recently been kicked out of CCF as a cost cutting measure - with no assistance at all now that they have served their purpose in CCF's fraudulent money generation racket.

      If any journalist Neeson would actually speak with were to ask him probing questions about CCF's education programs they would find that it is a house of cards, built on nothing. There is only one university graduate to show for it and most of the kids are getting a free education in government schools or at PSI. Neeson's education pronouncements, like much else that emerges from his lips, are lies.

    The human trash abusing human rights in Cambodia have a name: Naly Pilorge and Samleang Seila among the "Kill-Fletcher" Vigilantes who have no names but can be called the Peter Hogan Disciples. My hope is that they will eventually face the same torture that Fletcher has to go through.

      Which facts have I twisted? The fact that CCF has produced only one university graduate?

      If this fact is wrong, tell me (us) since you must surely know:

      ‘HOW MANY UNIVERSITY GRADUATES HAS CCF PRODUCED?”

      Have I also twisted the fact that Neeson claimed, for close to two years, that he was gifting World Housing homes to poor families when in fact they were being gifted to the owner of the land upon which they have been erected? If this was not yet more evidence that Neeson is a pathological liar, please explain to me (us) how it is that the facts are as such variance from Neeson’s spin?

      The list of lies and obfuscations goes on. Rather than simply accuse me of twisting facts, why not point out tome which facts I have twisted and supply the readers here with the correct facts, the correct numbers. Prove that I am twisting facts rather than just make such bald assertions.

      As for my deleting this comment, why would I want to do that? This comment, along with what amount now to hundreds of Team Neeson comments, speaks volumes about the total lack of commitment to the precepts of transparency and accountability on the part of Scott Neeson and CCF – an NGO that is mostly spin; smoke and mirrors.

      Given that most of the first intake of kids from the dump would have been young it is not all that surprising that there is only one university graduate after only a decade. It is all these education statistic I am arguing with here. On the basis of inside information they are all wrong. CCF’s so-called education system is a mess and producing close to zero in terms of clever students who might go on to become Cambodia’s leaders. From a donor and sponsor point of view educating kids is a great investment not only in their future but in the future of their families and of Cambodia. If CCF’s educational program is not working (as all the evidence suggests) and if CCF has hundreds of kids in institutional care who are not orphans (and it does) what is CCF doing right? Where are the results that donors and sponsors can look at and say, “Wow, what with all the setbacks and in the face of insurmountable problems, CCF is producing results.” CCF cannot produce evidence of this. All it can produce is yet more photos of Scott Neeson with little girls in his arms, photos of smiling children in classrooms, photos of Scott Neeson with famous people, photos of Scott receiving awards etc. Nothing substantial. And he is able to get away with all this because no-one will actually say to him, “Give us some evidence that CCF is doing what it says it does.” This is where the media is most remiss. It went after Somaly Mam (somewhat belatedly) for having told some lies. To the best of my knowledge Somaly Mam was not perpetrating the kinds of scams Neeson is. She was just a liar. And she lived the high life on the money she made from her lies. Why does the media go after a brown skinned Khmer woman and leave alone a white Australian man? Why is there no journalist in all of Cambodia who is prepared to ask Scott Neeson the most basic of questions and not accept spin as an answer? How will journalists and media outlets justify their turning of a blind eye, their silence, when Neesonps house of cards comes crashing down when it is revealed (as it surely will be) what a sham CCF is?

  14. Your battle against institutional child care by foreigners in Cambodia is something I applaud. The idea to create such an "Orphanage-NOT" business came from foreigners - mostly from western countries and quickly copied by some equally unscrupulous Khmer (LIKE FORMER APLE COUNTRY DIRECTOR HANG VIBOL WHO LEARNED HIS BUSINESS LESSONS FROM FRENCH THIERRY DARNAUDET FROM ST.PAUL LES DAX IN FRANCE). As in the case featured here, see below, former country director of APLE had no scruples when it came to sexually abusing children in his care. Thierry Darnaudet, the founder of the Vigilante-Gang Stalking NGO Action pour les Enfants (APLE) is in hiding after his main sponsor and buddy Andres Torres from Globalhumanitaria in Spain dumped him.

    We now have the "second wave" of totally unquallified travellers/backpackers who run unregistered child care institutions (estimated more than 5000 !) that have replaced the French business model. Now these people come from Australia, Chech Republic etc.  As always it is all about making money off the backs of impoverished families in Cambodia - many of them signing over their kids on vague promises that their kid will get accommodation, food, health care and a great opportunity to make it to Cambodia's top if they only join the CCF Business Model (as an example). APLE's Business Model promised parents that they would receive vast amount of money (10 thousand dollars being the average) if they cooperated to bring older western men down on child abuse charges. These men would serve their jail term in Cambodia and often enough never see a fair trial but more likely face a totally corrupt justice system like experienced by Brit David Fletcher and than be expelled from the country denying them to challenge the injustice at court. For many families that get approached by APLE this offer is too good to deny. It's a once in a lifetime jackpot without any consequences.

    Some western perverts of the khmer440 lynchmob vigilantes like the anonymous idiot posting here deserve to take the place of David Fletcher just to get a feel what it's like to get injustice.

  15. Ricketson - You have sealed the fate of Fletcher and destroyed any chance he had of getting an early release. Yes, go ahead and prop yourself up on a mantel, claiming that you have Fletchers best interests at heart. But the fact is, your constant criticism of the British Embassy has resulted in them refusing to assist Fletcher; your constant criticism of the Cambodian judiciary has resulted in them never giving Fletcher a chance for early release and your constant criticism of anyone who disagrees with your point of view has meant that you have zero credibility and zero support from any credible people. Now if you had of quietly behind the scenes worked with the people you constantly criticse instead of using your non-credible blog, advocating for Fletcher in a civil and professional manner, then I am positive that the outcome would be more favourable for Fletcher. However you have used Fletcher to your benefit. He will die in a Cambodian prison and it will be your doing!

      The British Embassy visited Mr Fletcher last week, clearly quite concerned about his health.

      Yes, I am critical of the British Embassy (or be more precise, the Foreign & Commonwealth Office) for destroying evidence of Mr Fletcher's innocence - namely his passport. I need not revisit the many lies that have been presented by the FCO to account for the accidental destruction of the passport.

      Mr Fletcher has not, this past 6 years, asked for early release. What he has asked for, and what he is entitled to, is a fair trial. This has been denied to him for six years. Previous letters to the Minister have, in fact, set the ball rolling and, it seemed, that Mr Fletcher was to have his appeal heard in the Supreme Court. Such a hearing was (and is) dependent on APLE making a submission the the court. APLE has failed to do so.

      You suggest working quietly behind the scenes. This I have done and, as mentioned, it got Mr Fletvher as far as a promise of a hearing in the Supreme Court. It has gone no further to date and perhaps it will go no further if APLE continues to refuse to do as it is legally required to do.

      And you, Anonymous 10.21, what have you done to help anyone obtain a fair trial? And if you have, were you able to succeed? Without doing what has been asked of me several times - paying "Big money" to the relevant authorities.

      Any and everybody with a modicum of common sense and some knowledge of Cambodia knows that the legal system is corrupt. Do you think that there are not people working quietly, diplomatically, behind the scenes to secure the release of the growing list of Cambodia's political prisoners?

      You and I both know that these prisoners will not be released until such time as Hun Sen can use them as pawns in whatever political manouver he believes will help him win the next election.

      One last point. I have never done anything, written anything in letters or on this blog, without asking Mr Fletcher's permission first.
