# 98 Smuggling documents out of jail!


The following was sent to UK Foreign Secretary Phillip Hammond one month ago. There was, of course, no response!

Dear Mr Hammond

Today I received the attached documents from Mr Fletcher – smuggled out of prison, photographed and sent to me. They speak for themselves. That such cloak and dagger antics must be employed by Mr Fletcher to communicate with CEOP and the FCO is absurd! Kafkaesque!

In accordance with Ross Allen and Joanna Roper’s fatwa on me (“we will not communicate with Mr Ricketson in any way or under any circumstances”) there is nothing I can do to assist Mr Fletcher to either (a) make an application to CEOP to acquire documents that he is legally entitled to under FOI legislation or (b) ask Joanna Roper when Mr Fletcher might be able to expect the second tranche of documents that were promised to be delivered to him in January.

The bureaucratic pettiness of Mr Allen and Ms Roper, on naked display, is of course the FCO’s way of trying to obstruct, in every way it can, Mr Fletcher’s quest for a fair trial! This is being done with your blessing.

Why, Mr Foreign Secretary?

There is a comic element to all this - of the Monty Python, Alice in Wonderland variety. In the note attached to these documents, sent to me by a very naughty prison guard today, I learned that during a prison visit by FCO staff last week to Mr Fletcher, a “skinny barang from Britain embusy with eye glases” was filming Mr Fletcher with his mobile phone while he “talk with Khmer woman from Britain embusy”.

Was this covert filming of Mr Fletcher done in hopes that he might use a four letter word and so give Ross Allen an opportunity to point out his duty of care to FCO staff not to have to hear such words?  I would be very surprised if Mr Fletcher used any four letter words. He has always been, in my experience, very gentlemanly in his dealings with those with whom he speaks.

I do not know at this point if Mr. Fletcher was aware that he was being filmed. He made no mention of it in his note to me. I have sent a message back to him asking if he was aware that his conversation was being recorded. I suspect not.

Why was the ‘skinny barang from Britain embusy with eye glases’ recording the conversation Mr Fletcher was having with the Khmer woman? Was Mr Fletcher informed that his conversation was being recorded? Is such covert recording of a conversation between FCO staff and Mr Fletcher legal, under British law? If so, can Mr Fletcher, under FOI legislation, request that he be provided with a copy of it?

I have included below the text of the letter I sent to Debbie Chisholm on 3rd Nov 2014 regarding CEOP involvement in the pursuit of Mr Fletcher.

I received no reply from Ms Chisholm. Perhaps she too has been instructed by you to not communicate with me?

Your email of 31st. Oct, far from being helpful, raises more questions:

“What are the names of the ‘partner agencies’ that led CEOPS investigation into Mr Fletcher?”

Is CEOPS happy with the way in which these ‘partner’ agencies’ have used the results of CEOPS’ investigations in legal proceedings?

These questions are pertinent both to Mr Fletcher’s forthcoming court case and to my own desire, as a journalist/writer and documentary filmmaker, to be in possession of as many verifiable facts as possible regarding this matter; to give all involved an opportunity to present their side of the story.

CEOPS investigators came to Cambodia in 2010 with the express intention of investigating allegations made by Scott Neeson that Mr Fletcher was ‘grooming’ young girls. In none of the court documents can I find any reference to CEOPS having uncovered evidence of Mr Fletcher’s being guilty of doing so. This leads me to believe that CEOPS did not find anything illegal or untoward about Mr Fletcher’s behavior towards young girls. Is this correct?

As CEOPS is well aware, Mr Fletcher was not charged in Cambodia with ‘grooming’ but with rape. As CEOPS is also aware (and has been since September 2010) the ‘rape victim’ was found by an examining doctor to be a virgin after the rape. And, as CEOPS is also now aware, the ‘victim’ has recently admitted, both to my camera and to other journalists, that no rape took place.

Whilst evidence pertaining to ‘grooming’ was not, in accordance with the Cambodian Code of Criminal Procedure, admissible in Mr Fletcher’s secret rape trial, Scott Neeson’s allegations (not backed up by any hard evidence) were aired in court and these played a role in the judges finding Mr Fletcher guilty of rape! (If you trace Scott Neeson’s allegations back, you will find that they begin with Peter Hogan, the owner of a Cambodian blog by the name of Khmer440; they began with a man who, by his own admission, spent 4 years pursuing Mr Fletcher with the intention of having him imprisoned.)

If CEOPS is in possession of evidence that Mr Fletcher was guilty of ‘grooming’ (or of any other offence against children) he should be charged with such offenses. He has not been. In flying all the way to Cambodia to investigate Mr Fletcher, and making your investigation publicly known to Peter Hogan, CEOPS cast a shadow of doubt over his behavior – raising in the minds of the general public the legitimate question: “Why else, readers of Andrew Drummond’s June 2010 article would quite legitimately ask, would CEOPS be in Cambodia investigating Mr Fletcher if there was nothing to investigate?”

The appropriate course of action for CEOPS to have taken, once it had completed its investigations in June 2010, would have been to announce: (a) We have found no evidence of Mr Fletcher’s guilt or (b) We have provided the Cambodian authorities with the results of our investigations.

Perhaps this is what you mean with your reference to ‘partner agencies’. If (b) be the case, the question arises:

“Is CEOPS happy with the way in which these ‘partner agencies’ have used the results of its investigations to have Mr Fletcher imprisoned for 10 years for rape?”

I am trying to place CEOPS’ involvement in a time line, Debbie, and I hope you can help me.

At some point in June 2010 CEOPS completed its investigation into allegations that Mr Fletcher had ‘groomed’ young girls. CEOPS had not come to Cambodia to investigate allegations that Mr Fletcher had raped Yang Dany. Indeed, at the time CEOPS completed its investigations (June 2010) no such allegation had yet been made. It was not until after Mr Fletcher had left Cambodia that the rape allegations were made.

Shortly after their return to the UK (June 2010), CEOPS investigators familiar with the case would have learned that Mr Fletcher had been charged with rape. Given that there had been no talk of rape a few weeks earlier, surely this must have caught their attention and made them wonder how this rape allegation could come out of the blue as it did, after they had left the country. And by September 2010, when a doctor’s report was prepared for the court, these same CEOPS operatives would have become aware that Yang Dany remained a virgin after her rape. Did no alarm bells ring for these CEOPS investigators? Did it not occur to them that Mr Fletcher may have been set up on fake rape charges to extort money from him? The CEOPS investigators could not fail to be aware that Cambodia is amongst the most corrupt countries in the world!

“Did CEOPS, in September 2010, ask any questions of its ‘partner agencies’ in Cambodia regarding Yang Dany’s intact hymen after her alleged rape?”

“If so, did CEOPS accept the proposition, endorsed by the judges in the secret trial, that Yang Dany’s hymen must have grown back?”

If CEOPS does not accept the ‘hymen-grown-back’ explanation for Yang Dany’s remaining a virgin after her rape:

“Has CEOPS made any representations at all to its ‘partner agencies’ – asking for more information? Particularly now that Yan Dany has admitted that no rape took place?”

Or has CEOPS washed its hands in the investigation and is prepared to see Mr Fletcher die in jail on the basis of evidence that would not stand up in any court of law in any country that actually abided by the rule of law?

By now, I think you will agree, CEOPS had been identified in a very public manner as being very much involved in both the investigation into Mr Fletcher’s activities in Cambodia and his conviction for rape. Refusing to answer any questions at all is not, from a moral point of view, an option.

Whilst I am primarily concerned with Mr Fletcher’s right to a fair trial, I am also interested (as both a journalist/writer and filmmaker) in the question of his ‘grooming’ of young girls. If he has done so, if there is evidence that he has done so, he should be charged with this offence.

This brings me back to my original question:

“Does CEOPS have any evidence at all that Mr Fletcher is guilty of ‘grooming’?”

If you simply refuse to answer this question, as I suspect will be the case, this will leave Mr Fletcher in a no-man’s land vis a vis his guilt or innocence. Some readers and viewers will conclude that CEOPS must have evidence of his guilt. Others will conclude that CEOPS found nothing and draw their own conclusions from CEOPS’ silence, in Nov 2014 - now that Yang Dany’s post-rape virginity and her denial that any rape took place are in the public arena.

One last question:

“If CEOPS found no evidence that Mr Fletcher was guilty of ‘grooming’, will CEOPS testify to this effect at Mr Fletcher’s forthcoming trial?”

I passed your email on to Mr Fletcher. He wrote an email back to me, asking that I pass it on to you. It reads:

Dear Debbie,

A recent communication from CEOPS to Mr James Ricketson has come to my attention that suggests and implies you have evidence of unsavoury acts with children by myself.

I officially request from CEOPS, as my right under the F.O.I. act that you supply me with copies of all documents you hold pertaining to me.

I attach a copy of my drivers licence as I.D. and i am very sure you are aware i am known by the the British Embassy in Phnom Penh. I do not have a valid passport as this was destroyed ' by mistake' by the fco in Bangkok,  according to their unsubstanciated explanation.
Furthermore, i request a fully itemised receipt and the return of my personal property that was in store and stolen in Phnom Penh in 2010 by CEOPS personell.

I also request the percentage of funding you receive from the fco, as an ngo this information should be freely available to the public.
This letter, your reply, or lack of may be published.

On a final note on my return to the UK i shall be paying CEOPS a visit for an explanation of their agenda.

I have attached a copy of a document signed by David Fletcher giving me the right to ask questions on his behalf. My question is: “What must Mr Fletcher do to make an FOI request to obtain copies of documents relating to his ‘grooming’ of girls held by CEOPS and relating to his forthcoming court case.”

If neither CEOP nor SISHA have any evidence at all that David Fletcher raped Yang Dany (and there is certainly none to be found in the court files, all of which I have) and if Yang Dany remained a virgin after the alleged rapes (which she did), and if Yang Dany denies that any rapes took place (which she does) and if the Foreign & Commonwealth Office acknowledges that David Fletcher was denied his right to a trial (and, as FOI documents reveal, it does) why are you, Mr Foreign Secretary, doing all you can to obstruct Mr Fletcher in his quest for a fair trial?

Curiouser and curiouser!

I have lost count of the number of letters I have written to you and I do not really expect a response to this email, though I would be delighted to be surprised and proven wrong.

The hole you are digging for yourself, Mr Hammond, gets deeper and deeper with every passing week that you allow this travesty of justice to endure.

  1. Wow, i never thought that the British Government was made of deaf, dumb and blind people that have no will and means to communicate in such a serious matter with a citizen in need of justice. So, apart from Cocktail Parties what do they do ?

    They know very well what is going on in the Cambodian Justice Circus since one of their representatives has visited the Court when Matt Harland's case came up. Their report confirmed that nothing went right at the court on that day.

    Even back in 2010 an american travel blog raised questions on how unscrupolous NGO in Cambodia used entrapment techniques in order to keep their business running.

    1. At least a representative of the UK Embassy in Cambodia sat in of Matt Harland's trial and saw that it was not conducted in accordance with the Cambodian Code of Criminal Procedure. David Fletcher was accorded no such UK Embassy representation when he appeared before judges in the Phnom Penh Municipal Court in Nov 2014 to be told that he would not be granted the trial promised to him. From the moment Scott Neeson accused David Fletcher of 'grooming young girls' to the present day the UK Embassies in both Thailand and Cambodia have gone out of their way to be as obstructive as possible - even to the point of destroying Mr Fletcher's passport.

      I expect, at some time soon, to hear from our friend who calls me a 'fucking moron' (amongst other things) on a regular basis. He (and others) may be interested in reading a Guardian article that begins:

    2. The word 'Conspiracy' is often mentioned in relation to David Fletcher's and Matt Harland's case. Conspiracy would mean that all people involved would've had a predestine plan and would've been in contact with each other to discuss the strategy. That's conspiracy.

      It's highly unlikely that Scott Neeson, Peter Hogan, Steve Morrish, Seila Samleang,Philip Hammond and other CFO staff have ever joined together to discussed the details of a strategy to setup David Fletcher or Matt Harland. It's more a cause and result thing.

      APLE doesn't act without a tip-off from the community. A few people from the NGO crowd, such as Scott Nesson, mentioning a person's name as a possible target is all that APLE needs to start an investigation.

      When after lengthy investigation APLE still has no crime, they start fabricating a crime by pressuring the families of possible 'victims' to make a complaint.

      Whenever APLE feels like the case is actually to weak to go to court, they start using their connections in the media and at the foreign embassies. That's where CFO comes in.

      The British, United States and Australian governments are not only funding the Child 'Protection' Industry, but they're also actively involved in the collection of evidence. They all have a mission and this mission is to report back to their home countries that funding is being used well. All parties involved know that real evidence is not that important in a Cambodian court, so accidentally losing a passport is not such a big deal, because who'll find out? As long as there's UK, US and Australian citizens going to jail, nobody will complain.

      Mr. James Ricketson, your doing a great job exposing the corruption in the Child 'Protection' Industry. It's been a true eye-opener to learn that the people involved in the Child 'Protection' Industry are such arrogant, self-righteous and at times even aggressive characters.

      Most of these characters involved shouldn't even be near children, let alone 'protecting' them.

    3. I don't believe that there has been any conspiracy either - other than a conspiracy of silence.

      I will not speculate here as to why Scott Neeson made the comment he did about David Fletcher grooming young girls but it was certainly, at the very least, a stupid thing to say. It gave Andrew Drummond the 'dirt' he needed to make his story sensational.

      Drummond has since been well and truly discredited as a journalist and now has warrants out for his arrest for writing articles about others similar to the one he wrote about David Fletcher.

      On the basis of all the evidence I have at my disposal now (and I have quite a bit) it seems to me that SISHA, CEOP, APLE, the British Embassy and the Anti-Human trafficking Unit had invested so much time and energy over a period of two years into nailing Fletcher they they could not let him simply walk out of the drama they had created. It was necessary for Fletcher to be a villain. The alternative was that they had all wasted a lot of time and money chasing an innocent man.

      At this point, Yang Dany's mother, having been told there was a $30,000 pot of gold at the end of the rainbow if she accused Fletcher with raping her daughter, laid charges. Yang Dany never laid charges but she went along with her mother - somewhat reluctantly.

      Yang Dany then plucked some dates out of mid-air (March 2009) for when Fletcher had supposedly raped her. The problem with this scenario, as became apparent to the British Embassy in Thailand, was that Fletcher's passport made it clear he was not in Cambodia in march 2009.

      Quelle horreur! What to do!?

      To avoid a considerable amount of egg on the faces of all those who had joined the 'Fletcher-raped-Yang Dany' witch hunt, his passport had to disappear. And it did. None of those responsible for it's accidental destruction ever considered the possibility that someone such as myself might ask questions. And so it is that Phillip Hammond's spin machine is going out of its way to prevent me from finding out more. Hence the refusal to hand over FOI documents that Fletcher was told he would get in Jan and which have not been given to him.

      Now, I have had a good bit to do with bureaucrats and spin doctors over the years and I know the way their minds work. They figure if they obfuscate, thwart and spin for long enough I will simply give up and the status quo will be maintained.

      We shall see whether or not they are right in their assessment.

      One thins is certain - this blog will make it very difficult for Foreign Secretary Phillip Hammond, Ross Allen, Joanna Roper et all to claim, at a later date, that they did not know what was going on.

      Quite by accident, this blog has become a place where interested parties can add to our collective knowledge of the ways in which some NGOs, some Embassies, some journalists, newspaper editors and newspaper proprietors become, through their silence, complicit in scams that break up families and see men like David Fletcher denied a fair trial.

      So, no conspiracy - just lots of self-interested individuals and organisations turning a convenient blind eye.

  2. The Freedom of Information Act info I requested from The UK Foreign and Commonwealth office reveals that the FCO did not fund APLE in the last 4 years.

    I wanted to know this as I often hear of APLE claiming the British Embassy funds them, using this to gain street cred.

    I was only able to ask for the last 4 years as there is a limit to how much work can be expended on a request before it is refused on a cost basis. If I went over 4 years they told me it would take them too many hours work to find the info and the request would have been turned down. The next stage is to do another request for the four years preceding 2010.

    Interesting to note they fund CCHR a lot. I contacted this NGO about APLE and in particular why they were not doing court monitoring on APLE cases – and surprise surprise everything went quiet!

  3. Nick, this is very interesting. It raises a few questions:

    (1) When was the last time that APLE mentioned the FCO as a backer in order to give it street creed? Any time in the last four years? If so, APLE is, at the very least, guilty of false accreditation.

    (2) Has the FCO had a 'road-to-Damascus' moment and realised that associating itself with APLE might be an unwise move?

    (3) Has the Cambodian Centre for Human Rights come to the conclusion that APLE is not quite the organisation it appears to be and wishes to distance itself from the NGO?

    (4) Who is supporting APLE now? LICADHO, of course! ADHOC? Who else?

    (5) Other than the fact that Naly Pilorge was one of the founders of APLE, why does Cambodia's pre-eminent human rights organisation work in partnership with an NGO that has demonstrated time and time again its lack of commitment to the basic tenets of what we think of as 'human rights'?

    (6) Last but not least, why is it that the English-speaking Cambodia media takes zero interest in the human rights abuses committed by expatriate NGOs?

    1. Exactly! Now is the time to bring APLE down for good!

      The Cambodian Government is doing all in their power to comply with ASEAN and is clearly tightening the rules. The new regulations on work permits for foreigners living in Cambodia is one example of how rules are being tightened, but there's more to come . . .

      This year there will be new laws for the use of internet, all cars and motorbikes will be registered in a central database and all government employees will get a chip-card and need to 'login' whenever they enter a government building. There will be more signs of Cambodia becoming more strict in the year 2015. All of these changes are managed by Hun Manet, the son of our prime minister Hun Sen.

      In line with these new policies is also the elimination of corrupt NGOs, such as Action pour les Enfants.

      It would be nice to have a summary of all individual stories and experiences in order to prepare an official complaint about APLE to the Cambodian Ministry of Interior.

      APLE is already under official investigation by the Ministry of Interior and the Cambodian National Police for violating the MOU with the government. All properly documented info about individual cases is appreciated!

    I am writing to you from Cambodia on an important issue (sexual child abuse) which is a concern to all of us in the Expat Community here.

    Since more than 11 years now one Person, namely french national Thierry Darnaudet (you reported his suicide attempt in July 2007 in a 4 star hotel in Kolkata) and his NGO aplecambodia.org is using Cambodia as a platform for his unscrupolous Gangstalking, Vigilante Witchhunt which is unfortunately beeing supported by many NGO and western Governments. The truth is that Darnaudet lives in Kolkata most of his time and according to his own statement is involved in everyday life at the ACTT NGO (all children together trust) in Kolkata. He has absolutely no credibility to work with children and basically no education on anything else apart from beeing a librarian.

    I want to assure you that every single foreigner residing here hates child abuse in any form and combats it with the police if he witnesses one. We have contacted one of his nearby neighbors in Kolkata b-i-f.com but unfortunately they are only interested in Cult and Religion Issues which are equally beeing exploited by foreigners in India.

    We wish you would do the investigation in Kolkata since we are unable and don't have the necessary resources to do it ourself, beeing in Cambodia.

  8. MATT HARLAND

    I have not followed the Matt Harland case closely and, indeed, know little about it. However, when I saw some photos online of the girls who gave evidence against him I recognised all three of them.

    APLE and others that publish such photos (even when faces are pixilated) must realise that anyone who knows these girls will recognise them from their body posture, walking gait and other clues.

    So, it took me five seconds flat to recognise all three girls and less than an hour to track two of them down and conduct interviews with them. What is interesting about these interviews is that the two girls give quite different accounts of what transpired (or was alleged to have transpired) with Matt Harland. More interestingly is that I know, in relation to one key fact at least, that both girls are lying. I will keep the details of this to myself for the time being but in the event that Matt Harland was ever given a fair trial I believe the contradictory testimonies of these girls and the fact that one key element of both their stories is demonstrably untrue, would see the case thrown out of court. Out of a properly constituted court, that is; a court whose judges had not been handsomely rewarded to arrive at a desired verdict regardless of the evidence.

    If I can find such things out with such ease (including the fact that David Fletcher's alleged victims remained a virgin after two 'brutal' rapes) why can't officials within the British Embassy? Or, do they know such things but simply don't care that a citizen of the United Kingdom has been jailed for a long time with no trial and on the basis or little or no evidence?

    It's absurd that APLE is allowed to continue harming children!

    The children, ages 5 to 11, are among a group of boys first reported by the Post to have been taken from their families last August during the arrest of an Australian teacher charged with sexual abuse.

    The mothers allege the boys were initially taken by police without explanation, and are now being kept as witnesses against the families’ wishes.

    “When I went to see my sons at the centre, they said they sleep in the hall without any blanket or mosquito net. They say they are cold and afraid to ask for anything,” Chanthon, one of the mothers, said yesterday.

    Despite pleas from the parents and from the children, the shelter won’t let the young boys go, the mothers said.

    “They tried to run away,” said Vun, another of the mothers.

    And look at the weak excuse of APLE to justify these crimes:

    “The mothers are still strongly supportive of the suspect. It is part of the grooming techniques of the offenders to build such trust,” said Khoem Vando of APLE
    According to Vando at APLE, if children tell police they were harmed, they are “automatically included in the case file and the court has the right to summons them”.

    This is ABSOLUTELY NOT TRUE. The truth is that ALL children that were ever alone with the suspect are automatically targeted as potential 'victims' and locked up at Hagar International util the trial.

    Why is it that nobody cares about this? Why it that nobody responds to our allegations against APLE? Why is it that other NGOs, such as Licadho, Adhoc, turn a blind eye and remain silence? Why is it that NGOs, such as Scott Neeson's CCF and Steven Morrish's SISHA cooperate with such a criminal NGO?

    Scott Neeson and Steven Morrish don't respond to our allegations against APLE, while they know and everyone in Cambodia knows that APLE is a criminal organisation that violates the rights of children and their families. Don't you guys have any conscience?

    And how about Scott's Child 'Protection' Unit and Steven's SISHA? Are they using the same modus operandi as APLE? Is the CPU also 'protecting' children by letting the crime happen before taking action? Is SISHA also pressuring families and coercing children into making false accusations against foreigners?

    According to a comment on this blog Steven Morrish used to work for another highly controversial NGO called IJM (International Justice Mission). IJM is responsible for putting Australian national Giuseppe Nicolosi behind bars for rape he did not commit. IJM had offered $5000 compensation to the parent of the 5 year old 'victim' if they'd complain MR. Nicolosi.

    Does anyone know if CPU and/or SISHA apply the same unethical 'protection' techniques?
